2010 Unemployment Extension Best Case Scenario -- Bill Could Be Signed by Week's End

H.R.5618 Is Best Chance for the Unemployed to Get Unemployment Benefits Flowing Again Within a Week

Before Congress recessed for the July 4 holiday, the House of Representatives passed a standalone unemployment benefits extension measure, H.R.5618. The Senate, having failed to reach cloture on H.R.4213, an umbrella bill that included unemployment extensions, as well as Medicaid provisions for the states, for the fourth time in June, had recessed the evening before, basically putting the bill on hold until after the recess, and relegating those who had lost their unemployment and those whose extensions had expired since June 2 to limbo until after the July 4 recess.

But, with the reconvening of the Senate on July 12, according to OpenCongress.org, H.R.5618 could be signed by President Obama by week's end, and much-needed unemployment benefits could be flowing again into the hands of those depending on them to pay their bills. But, what has to happen for H.R.5618 to reach the President's desk before the weekend?

Bear in mind that the passage and signing of H.R.5618, which would further extend the unemployment extensions to the end of November, by Friday depends upon several things, but two things in particular: the quickness with which Senate Majority Leader Harry Reid (D-NV) submits the bill for cloture for proceeding to bill, and how determined the Republicans are to filibuster and stall the passage of the bill, which could delay the bill being passed and signed until sometime next week.

A quick breakdown of the best case scenario for passage of H.R.5618:

1) Senator Reid files motion on Monday to invoke cloture on proceeding to bill.
2) One hour after the second day after motion is filed (Wednesday), motion is "ripe," and Senate will vote on cloture.
3) Once invoking cloture has passed (which takes 60 senators voting affirmatively), Senator Reid can file a motion for actual cloture of the bill itself, which takes 60 votes to pass as well.
4) As with the invoking cloture for proceeding to bill motion, the motion for invoking cloture also takes two days to become "ripe." Again, one hour after the second day (Friday) after filing, the Senate can vote on cloture.
5) By Senate custom, the majority party is usually allowed to submit the bill for an up-or-down vote, which requires 50 votes to pass.
6) President Obama signs the bill within hours of its passage.

But that's the best case scenario. With the Republicans' track record of stalling, objecting, and filibustering on the various unemployment benefits extension measures that have gone to the Senate, it could take somewhat longer. And, a 60th vote for the two cloture votes may not come that easily.

The Democrats were one Senator shy in their last vote, and, with the death of Senator Robert C. Byrd (D-WV), their attempts at reaching 60 became a little more difficult. And, since West Virginia governor Joe Manchin decided to wait until a special session of the West Virginia state legislature before appointing Senator Byrd's interim replacement, the 60th vote still requires at least one other Republican "yea" vote (besides the two Republican Senators from Maine, who voted for H.R.4213 on the last vote) or Senator Ben Nelson (D-NB), who has voted against cloture in the past, returning to vote with his fellow Democrats.

And, there are other ways the passage of the bill could be thwarted or delayed. The most obvious, of course, is that H.R.5618 does not gain cloture. But, barring direct failure, there are other ways to delay the bill.

For example, if Senator Reid delays filing the motions of cloture, for whatever reason (such as delaying long enough to attempt to gain passage of the more extensive and overarching H.R.4213), the process is delayed for each day of delay. If he should file for the first cloture vote on Tuesday, then, by Senate rules, the bill cannot be voted on until Thursday. Each successive day of delay pushes the final passage vote, should the bill gain cloture, back another day.

Once the bill has gained its two cloture votes, there is still one method of delay of final passage available to Republicans. Although it is customary for the minority party to allow the majority party to present the bill for a final vote shortly after reaching cloture, by Senate rules they can keep the bill held up in the Senate for another 30 hours before a final up-or-down passage vote takes place.

It is estimated that the number of individuals whose unemployment benefits extensions will have expired by mid-July will climb to over 1.5 million. For each week of delay in passing an unemployment extensions package of some form, another estimated 200,000 see their benefits expire. For many, mired in an economy where there are five applicants for each open job position, an unemployment benefits check is all there is between losing a home, a car, and/or keeping the utility bills paid.

The Department of Labor estimates that there are at least 15 million people unemployed in the United States. Of that number, roughly one-third receive unemployment benefits. Over 6 million people have entered what is known as long-term unemployment -- being unemployed for 27 weeks or longer -- which is the highest long-term unemployment rate since documentation of unemployment records began in 1948.

    This is a solution to the unemployment crisis that will make everybody happy. This will not only make the unemployed happy but also the congress and senate because it SAVES MONEY and SOLVES THE PROBLEM and they won't have to deal with it ever again. Give all unemployed 99 weeks max to draw benefits then or at anytime they choose before the end of their 99 weeks give them 15,000.00 dollars each non taxable money so that they won't lose their homes, they can pay off debt, and start their lives over and make plans. Then cut them off when they receive the funds. This saves money because 15,000.00 is less money than they would draw by extending their benefits figure it up. This saves the US money and also the congress and senate will not have to deal with it again. This is set in stone and can stay this way until the economy improves then it can be changed.     What's really sad is these elected folks.....living HIGH on the damn hog have no idea what is to have no money and no job, because of deep DO-DO they helped put this Great Country in. Extend the damn unemployment benefits,so we can pay our bills,look for work and so-on.MR. President step in and something to help the people of this so called Great Nation.

    it sure is strange how no one saw this coming around15 years ago when the nafta agreemnet was signed and the first wave of american jobs went to mexico then a few years later we opened up the importing from china and the balance of the selling out of america fac it people we saw this coming 15 years away and we stood by and did nothing to stop our jobs from going being outsource not only that the clowns in congress gave the same people who took our jobs abroad oh get this a taxbreak and then we bail them out with the same money oh yea our money that the tax our bread,gas,income,fees for this and fees for that,well and now they tell us we are the problem oh yea for working all my life putting into system that cant i cant even get food stamps from,wake up its time to take back america give it back to the americans,i think we can screw off our own money and feel good about instead of putting it some clowns hands and let them screw it off,i felt better if theyd just said pull your pants do

    VOTE NO ON INCUMBENTS!!! This current Congress Democrats and Republicans have failed the American people in every way possible. These career politicians have lost all touch with reality and the ones that haven't have closed door deals that gets in the way of doing what's right for the American people. Congress should have their paychecks suspended and their vacations canceled until they get the extention passed, maybe then they will get the idea of what millions of us are going through right now!!! Unemployment benefits are NOT a hand out, it is an insurance that you and your former employer paid into and I find it very insulting when it's referred to as welfare!!! We the American worker earned the right to those benefits in the time of economic crisis. Tell me how cutting off benefits helps the economy?     Went in air force when I was 17;for 4 years. Worked all my life ,I'am 62 now.Every place I worked closed and the jobs went over seas. 62years old now, lost one half of my 401k. they baled out wall street after the greedy stold my only retirement,no won wants to hire a62 year old man when there are so many young guys out of work looking for the same jobs. The greety vote them self a rase,then stop my only means to get my medacaction and food..     Someone posted that the unemployed don't have lobbyists, I disagree we have ourselves and it doesn't have to cost much to be heard. What if we just emailed every senator from every party repeatedly every half hour for an entire day. lets close down their emails and websites....Just created a backlog in their getting any information except from us. how hard would it be to do repeated e blasts. It is not spam since they have the sites set up for us to contact them. they also keep count of hits as well as names, why not use what we have? A voice

    Worked all my life since 17 and now 50 and have sent out, talked to and walked for a job. McDonalds said I was OVER QUALIFIED, I AM NOT WHAT THEY ARE LOOKING FOR...I used to make a livable wage...I would dig ditches if I could get a job! Minimum wage job is no problem here! I just want to work. Well it's official I get to decide now which one to buy...either peanut butter or the jelly? Had to cut the bread out of the budget so I am using a spoon to eat my delicacies...screw the fact I can not pay my bills so my credit is ruined! I have No cable, no phone, getting ready to use the candles. Been washing clothes by hand and praying it does not rain so I place them outside to dry. I see a tent coming in my future. Nope can't have a tent either...NO MONEY TO BUY IT! I don't smoke or drink....Car was repossessed can't live in there! It is going to be stealing and killing just for food.
