The standard living will is the matrix and demonstrates the application for my plan.
A Pledge to Stay in Touch
I, for one, as a responsible son, spouse and parent, do hereby waive any privacy issues preventing a search for me as soon as possible. Can I do that? Can I myself waive my own privacy rights?
Will this document express that wish? Pledge.
I do hope that a search for me, should I fall off the radar, will commence as soon as possible.
Like a living will, can I myself express my wishes as a missing person -- before I go missing? It's easy to say..."he wouldn't just not come home..." What if I pledge this is in legal form?
A revelation? A publicity angle to get media coverage for the case in question? A real answer to the issue? I know it will stir debate, but debate usually helps spark progress.
How do you think this might be used in a situation? Might it help, hurt or be of no effect at all? Is this something you would want to keep on file with your living will or other legal documents?
Are You Prepared?
No one ever thinks it could happen to them. No one expects they will ever go missing. But what if you do? Are you prepared? Are your family members or close friends prepared to provide the authorities with enough vital information to begin an immediate search for you? And will they have enough vital information on hand at this time of crisis when this information is so important to have? Who better to supply my own vital information other than my own self?
Most laws require a waiting period before a report of a missing adult can be filed. The problem with this is; we all know, the first 24 hours are the most vital in a search, therefore providing the authorities with a written request on your behalf to by-pass those laws and begin a more immediate search may prove helpful. Already, some laws require a missing persons report be taken, but that doesn't mean an actual search is started until much later.
Legality?
After seeking input from the legal world, some think this is a good idea, some are not sure how it will act as a legal document. But it would be an asset to show my intent.
Privacy laws are important no doubt. Every adult has the right to leave whenever they wish. But these privacy issues also HURT the ones who need immediate help. If I waive my privacy rights by my own free will and purposely provide tools to help locate me and spare my family heartache...why not? I feel the privacy right for those who want to go missing infringe on the rights of the legitimate missing being found.
Rescue or Recovery?
If I do not come home tonight -- I am sick, dead or otherwise in trouble beyond my control -- and I want someone to come and find me. I might be trapped in my car, crashed over an embankment, unconscious and bleeding. A few days later it will be recovery rather than rescue.
This type of document isn't for everyone -- not all of us fill out our donor card or the standard living will. But this can help some folks, maybe save a few lives -- I hope. Its wording would provide vital data needed as well as an authorization to begin an immediate search.
