ACLU Vs. Nassau County School Board: The Fight Over a Gay-Straight Alliance Club

Damon C Dennis
All school clubs have been shut down in Nassau County Florida. This is because a few students desire to start a Gay-Straight Alliance Club. As a result the rules regarding school clubs were rewritten. Now, a charter is required to have a club open. Even though the National Honor Society has a charter it is also closed down, but it is expected to reopen soon.

Since the GSA Club was denied the ACLU (American Civil Liberties Union) decided to sue the Nassau County School Board.

According to the ACLU the Equal Access Act protects the student's rights to have this club on campus.

The ACLU won a case just like this in the Okeechobee County School District. The Okeechobee School District had to pay $326,000 in attorney fees. Tax dollars well spent. Maybe.

Nassau County School District can expect to be hit with the lawsuit in the beginning of 2009 if the GSA Club is not allowed on campus.

My question is, where does ones sexual preference have a place at school? I don't see any religious clubs at school. I wonder if the students that are against the GSA club (trust me there are) will start a "Straight Club". I know it sounds ridiculous, but these two possible clubs seem to be cut from the same cloth.

Nassau County is a very conservative county. They are very religious, and a majority proudly label themselves "Red-Necks". They voted 80% McCain. Nassau County is not ready for a "Gay Rights" school club. This is not New York.

Back to the potential cost of this lawsuit, will the school board concede and allow the club. Or, will they find enough funds to try and fight the ACLU?

Personally, I feel that (insert current politically correct term for homosexual here) should have rights. However, the same people that are for gay rights, clubs, etc. to be in the school system, namely liberals, are also against religion being involved in the school system.

How can they be for one group, but against the other? I am all for equal rights, that's also why I'm against Affirmative Action, but if you want equal rights then don't limit the rights of other beliefs.

The result of the coming lawsuit may allow the GSA club, but it will also create animosity between GSA club members and students against the GSA. Do we really need more tension is society? If anything, there should be a "Tolerant Club" where students get together and become tolerant of others races, religions, sexual preference, and other miscellaneous beliefs.

I know this is very old but since no one has commented and this still seems to be a commonly held sentiment I’ll reply to your points. 1. It doesn’t matter if it’s a “very religious“ “conservative county” or if the majority of they students attending were against this group(and homosexuality) for whatever reason legally as a public school it is a student’s rights to start a GSA, even if there are no religious clubs(shocking I know). 2. religion is allowed in the school system, a student can pray read there holy book of choice and start a religious group, what is not allowed is religion that is lead, mandated and officiated by the government.

“if you want equal rights then don't limit the rights of other beliefs” in what way is allowing a GSA limiting the rights of others? “If anything, there should be a "Tolerant Club" where students get together and become tolerant…” that’s the point of a GSA to open a forum in hopes of lessening animosity, intolerance and homophobia toward GLBT people that is already present, dumbass. “I wonder if the students…will start a Straight Club…these two possible clubs seem to be cut from the same cloth.” no there not one group is a response to anti-gay bullying the other is the brain child heterocentric idiots who don’t/didn’t have to go though the same Sh!!t as there gay peers.
