When magistrate Giuliano Mignini took on the duty of Chief Prosecutor in 2007 for the murder of British student Meredith Kercher, 21, he had already been indicted- in 2006- for abuse of high office, illegal wiretapping, and dereliction of duty in the case of the 'Monster of Florence'. In the summer of 2009, a Florence court delayed a decision on the accusations, which gave Mignini the leeway to continue as chief prosecutor of the murder trial, which ended in December. On Friday January 23 2010, the Florence court convicted and sentenced Mignini to sixteen months imprisonment. The sentence is suspended and Mignini continues to function as a magistrate while he awaits the outcome of an appeal.

For two years and three months, two innocents associated with the Meredith Kercher murder, in Perugia Italy, have suffered at the hands of Giuliano Mignini, a man who divines theories and then endeavors to fit evidence to them- as a learning-disabled child tries to fit square pegs into round holes. The innocents are American Amanda Knox and her ex-boyfriend Italian Raffaele Sollecito, who were wrongfully arrested on November 6 2007, jailed without bail, and on December 4 2009, convicted of Kercher's murder. The convictions will be appealed. The Italian Supreme Court has acknowledged that the human rights of Amanda Knox were violated. A third person was also convicted.

After Meredith's murder and before examining the evidence, Mignini's fertile mind fabricated a story of three satanic drug abusers- two men and a woman- coming together on the night of November 1 2007 to induce Meredith into a ritual orgy- an 'erotic game' of group sex. When Meredith refused to play, the woman became 'incensed and violent'. One man held Meredith as the other man raped her and tried to strangle her. Then, the woman stabbed her with a knife. The trio covered their victim with a duvet out of pity and respect. "Amanda, especially as a woman, couldn't bear that naked, torn female cadaver," said Mignini. He also said that the trio left but the two men returned later to stage a break-in by breaking a window.

Yes, Mignini's three attackers in his story were Amanda, Raffaele, and Amanda's boss Patrick Lumumba, whose airtight alibi soon excluded him. Fortunately for Mignini, another suspect dropped into his lap, Rudy Guédé, who had fled to Germany on the day after the murder, was discovered, and soon extradited.

Mignini's story has since been dematerialized by the defense lawyers for Amanda and Raeffele. And experts have shown there was only one killer. But the story of a murderous satanic group is not a new story for Mignini to tell. In the case of the 'Monster of Florence'- il mostro di Firenze- for which Giuliano Mignini was convicted on the aforementioned charges, he had divined a theory about a satanic cult, even though though evidence- including FBI files- showed one killer. "The Florentine prosecutor, Luca Turco, has accused Mignini of being 'in thrall to a sort of delirium' in his handling of the 'Monster' case, in which he fantasized amazing and complex Satanic conspiracies," says Douglas Preston, who co-authored the novel The Monster of Florence with Mario Spezi. Preston believes that Mignini has treated Meredith's murder in the same delusional manner. "I believe the same could be said of his handling of the Kercher case, that he is suffering from some kind of delirium," said Preston.

The evidence- or lack thereof- in the Meredith Kercher murder says the same. No evidence of Amanda's presence was found at the crime scene in the Perugia cottage- no hair follicles, no fibers, no blood, no DNA. The same was true for Raffaele but for Meredith's severed bra clasp. His DNA was found on it. However, the bra clasp was not collected for evidence until 47 days after the murder. By then, the clasp was in a different location in Meredith's room of the Perugia cottage, as evidenced by police photos.

At the time of its collection, the clasp was handed from one gloved polizia scientifica to another until one of them, after touching it repeatedly, accidentally dropped the clasp on the floor. He then picked it up and put it inside an evidence bag before taking it to the station. Whatever else the polizia scientifica had handled in their gloved hands from inside the cottage before they handled the bra clasp is unknown.

The third person arrested and convicted of Meredith's murder was Ivorian Rudy Guédé. He was sentenced to thirty years but will be set free in sixteen. However, his DNA was found throughout the crime scene and inside the corpse of Meredith Kercher.
