An E-mail to Ohio Governor Bob Taft Regarding Ohio's Controversial Child Support Laws

I sent an email to former Ohio Governor Bob Taft's office last March requesting an explanation of Ohio's controversial non-support license revocation law. Specifically, in Ohio, "dead beat dads" can have their drivers licenses revoked for non pay of child support. The email was not answered by Taft, but was forwarded to the Ohio Office of Child Support.

It is my contention that by revoking a non-pay father's license, even greater, potentially crushing, financial hardship would ensue, and that garnishment of wages should be sufficient enough. I recieved a prompt, courteous response shortly after.

Here is the unedited reply. I allow the reader to draw any conclusions on their own:

In response to your concern regarding driver's license suspension. Driver's license suspension is one of a number of enforcement tools available to the Child Support Enforcement Agency (CSEA) when an obligor (non-residential parent) is in default. However, before a drivers license suspension occurs, an "Advanced Notice of Default" is sent to the obligor explaining default and the potential actions that can occur to enforce payment of child support, including driver's license suspension. In fact, many CSEAs send a warning letter to the obligor prior to actually suspending the driver's license. If an obligor is experiencing difficulties in paying his or her child support obligation, he or she needs to work with the CSEA.

You also mentioned wage garnishment as being sufficient to enforce a child support order. An obligor's driver's license is not normally suspended if there is an income withholding order in place with the
employer and payments are being received. However, in most cases when an obligor's driver's license is suspended, the obligor has failed to provide the CSEA with his or her employment information. Under Ohio law, the obligor is required to provide employment information to the CSEA as changes occur.

    i have not had my license nor have i paid support in the last 6 years ,clermont county will not work wt me and yet i spend time wt my children ,i have 4 driving under suspensions ,i care very much about my life and future and dont know what to do .jail ? ok ,what will that resolve ? i started getting behind when my partner was diagnosed wt brain cancer and i missed work ,i didnt know my license was suspended untill i was pulled over for speeding and from then it just went downhill wt not much money coming in ,insurance copays ,, , i spoke wt my c/s case worker ,and was told that i needed to pay my arearage and current or i could go to jail for 6 months .ok ? now thats even less than helpfull so now i work cash jobs hardly scraping by and its either a direct result of me not making enough money to go around or clermont county c/s hoping to improve the situation by taking my license and i dont know how many jobs iv lost for lack of a dependable ride .bottom line is it is my responsability and i have tied my own hands . . .

    Part of the situation also revolves around the custodial parent. The CSEA is content to do nothing unless the custodial parent is calling in to ask where the child support is. While driver's license suspension is the only way my ex will pay, there is flexible ground and negotiating that can be done with the custodial parent's permission. If you ex is out to have your head on a silver platter, he/she can tell the CSEA no. If you are unhappy with your caseworker, contact the Ohio Office of Child Support. Sometimes they can assist whether you pay or receive.

    IS THERE ANYONE OUT THERE WHO KNOWS WHERE I CAN GO TO SIGN A PETITION OR LOBBY AGAINST THE LICENSE SUSPENSION LAW AGAINST BACK SUPPORT? I HAVE TWO FRIENDS THAT ARE OFFICERS AND THEY EVEN SAID TO ME, "AN OFFICER DOESN'T have TO SITE YOU." THANKS TO THE BIG MONEY MACHINE CALLED THE GOVERNMENT, CHILD SUPPORT MADE IT THAT MUCH EASIER FOR THE GOV. TO TAKE YOUR MONEY.     i dont think that taking someones dl away will solve the problem. child support is not sensitive to peoples needs. case in point. my daughter is 11 yrs old and i have been paying child support for them 11 yrs. no problem. just recently i got hurt on the job and now recieving workers comp. they took my dl because i couldnt pay the full amount. because the income that i have now is nothing compared to what it was before i got hurt. so its hard to keep up with it, i ask for a modification and they denied me. so now the take a big portion of my workers comp. check and now it hard for me to stay on top of my bills and things here at my own home

    I have a daughter that was only ordered to pay $51.00 per month. She has paid for 2 months out of 4 years and she is now gone again. By the time she is far enough in debt to be looked for or anything else to be done her daughter the child will be of age. That won't even raise her support so she can be found. That is a double edge sword.

    I agree with the license suspension. The hardship of the non-paying parents is minimal compared to the hardship of the child and custodial parent when support is NOT paid. I wish they would take it a step farther and charge INTEREST on unpaid child support in Ohio. Some states already have done that.
    In my case, my ex was working and making just about 100k a year. As soon as the divorce papers were filed, he quit his job. He has worked under the table for the last 7 years. Amazing that he has $$ to go on vacations and travel, but yet cannot comply. We have been to court on contempt, and 2 days before the hearing he paid to current. That was 2 years ago. Since then he has not paid a dime even though he was warned. The process of going through CSEA is a long one. This time I had to wait 6 months for the legal department to issue orders to suspend his license. He was given 14 days to comply before they suspended his license. Now he has an additional 14 days AFTER the suspension before sh

    Not just license suspension. They will also issue a warrant for your arrest that is a 5th degree felony.

    Now with all the budget cuts in Lake and Geauga counties, it looks like there are going to be less and less people available to help.. I know I'm still waiting for my child support.
