Army Cannot Supplant Judiciary: In Fact it is a Subordinate Part of the Administration, Not an Equal

Investing the Army with the Power of Judiciary is Subverting the Constitution of This Land

The true pillars of democracy are three independent constituents with each acting as a check on the powers of the other:

1. The President 2. The People's representatives 3. Judiciary

Army is a subordinate wing of one of these. Army is not equal to any of them.

Asking that judiciary be subverted by the army is striking at the very root of this country's existence OR ignorance or forgetfulness of the fundamental principles on which this great country was founded.

Opportunistic and self-serving demands that judiciary be superseded will ultimately lead to army rule.

That has been the final event in all countries where it was tried in the past.

Because once the original aim was achieved the army was used to kill political opponents and that led to civilian dictatorships.

And civilian dictatorship was soon usurped by military dictatorship.

Remember, the founding fathers of this great nation were not fools when they decided against a huge standing army like the Soviets or the Chinese. They knew the disadvantages far outweighed the advantages. And it becomes easy for a federal government to subvert states that don't agree to everything they decide in Washington.

And they couldn't even broach such an idea because they themselves were victims of European monarchies and their authoritarian oppressions which even decided people's faith and beliefs.

So when they came over to this land they preferred a drafted army to a standing army. To this day we didn't have any reason to regret our founding fathers' wisdom.

If any politician now decides for electoral victories, that judiciary is not suiting his tastes, it is his own selfish and myopic motive and it has nothing to do with this country's foundational ideals.

If our able founding fathers decided that a judiciary is quite capable of doing its business, then small fries of today cannot ask that judiciary be supplanted by the army.

Yes, we are eternally indebted to our warriors for their sacrifices. But that doesn't mean that we dismantle the foundations of democracy, so painstakingly built up by our forefathers.

Judges are not just scarecrows, they are there to assure that the other two pillars of our democracy are functioning according to the constitution of this country. One cannot dismantle the other two.

When judiciary doesn't exist, is superseded or silenced, democracy doesn't exist. And when democracy doesn't exist freedom doesn't exist.

Playing political and ideological gimmicks to win elections is one thing. Striking at the very foundation of this great nation for short-term gains is entirely different thing.

I am sure that we are far better than the Ahmedinejads and Kims of this world. Then we cannot act the same way our enemies act.
