How Would You Expect Lawyers to Vote on This?

When the State of Texas proposed the introduction of a ban on lawyers having sexual relations with their clients, 72% of the members of the Texas State Bar voted to reject the proposal.

This is one of six amendments that were presented to members of the bar in February, all related to the Texas Disciplinary Rules of Professional Conduct.

Given the reputation that lawyers have, especially in the United States, how surprised would you be to learn that all six of these proposed amendments were rejected, some by a margin as high as 3:1 against them.

This amendment in particular would have barred a lawyer from having a sexual relationship with a client, unless that relationship had begun prior to their representing that client. The voting was 27,731 against the proposal, and only 10,617 in favor of it.

It is possible that despite the mass protest by lawyers in the state, the Texas Supreme Court may go ahead with making this ruling law, in which case expect a major protest from lawyers in the state if this does happen.

As to why so many lawyers in Texas voted against a change in the law that would prohibit them from having sexual relations with clients, we can think the worst, but it's likely that it was just a protest vote over the amendment process, rather than their not wanting to be involved in a mass of lawyer client scandals.

It will be interesting to see what the outcome of this will be.

    Unless someone is being taken advantage of, consenting adults are consenting adults. That's as far as I care who sleeps with who.

    As a retired legal secretary, I never worked for any lawyer who had a relationship with a client. It just wasn't done. However, that doesn't mean it doesn't happen.

    I think it's sad if you genuinely do meet someone and fall in love, and they happen to be a client. It doesn't matter whether you are a doctor, laywer or whatever. However, I do also agree that it's not a good thing when it affects possible mis-use of information and perversion of justice. Not nice to be caught in that situation though.

    Come on, it's Texas. You are surprised? I don't understand Joe's comment. A lawyer is not a trail guide. I know few trail guides that handle life and death situations, divorce, criminal defense, etc. Lawyers are entrusted with secrets and is there usually in emotional turmoil. Much like a therapist, sleeping with a client is always a bad idea.
