Baby Gabriel 'Missing Person' Becomes Homicide but 'No Murder Evidence' Says Jay J Armes
Homicide investigators will search eastside of Tessman Road Landfill. "The question becomes 'why are you searching that landfill if it's a missing person case'," said McManus. He indicated that SAPD have several leads to finding Baby Gabriel alive. McManus hopes nothing will turn up in the landfill and that instead 'we'll find him alive'. When the search starts depends upon the weather. San Antonio has had much recent rain. Potential toxic run-off from landfill is dangerous to investigators.
The landfill search is based on a brutal text message sent to Baby Gabriel's father, Logan McQueary, by his mother, Elizabeth Johnson, on December 27 2009, the day that Gabriel went missing: U will never see Gabriel again. I made sure of that. And u can spend the rest of ur pathetic life wondering about him. U will never find me im already bording a plane. Out of the country. When im safe ill email u the exact location of dead gabriels little blue body. if the garbage don't come first. This is what liars like u deserve.
The conflicting statements and obvious lie (Johnson was not boarding a plane) in the excerpted message raises hope that the entire message is false. Johnson also said she had cut up the baby (as in early news reports). Yet, as Private Investigator Jay J. Armes said in a taped interview today, no murder evidence has been found, "We have not received any indication that they [investigators] have found any traces of child or blood, or a child that was cut up like she said she had done."
Jay J. Armes and his son Jay J. Armes III are working to find Baby Gabriel with a powerful pro bono investigation team recently assembled by Armes, Senior. Their investigation is based on the premise of a later Johnson statement- that she gave away Baby Gabriel- and on their belief, based on certain facts, that she sold the infant boy. They are looking into human trafficking and underground adoption in Mexico.
Gabriel's father, Logan McQueary, is in San Antonio Texas with Jay J. Armes. He has met with SAPD's Chief McManus. After spending many hours with the Chief re the work done on his missing son's case, McQueary's criticism of the SAPD has turned to praise. "I feel a lot more comfortable now with the San Antonio Police Department, the detectives there. They are actually doing a lot more than everybody knows," said McQueary. "Gabriel's... out there somewhere," he added. "We're hoping to find him."
McQueary plans to follow Johnson's trail with Baby Gabriel in San Antonio and pass out 'missing flyers'- he printed out 1,500 today. Among the locations he will visit is the HomeGate Studios & Suites in Fiesta Park where mother and son stayed for the week of December 20. He will also visit the Motel 6 where Johnson abandoned her grandfather's Oldsmobile.
Six days elapsed between Johnson's arrest on December 30 and the discovery of the Oldsmobile on January 5, 2010. Among other places visited by Johnson with Gabriel are the Russell Raymond County Park and Six Flags Amusement Park. Expecting to find all the answers in San Antonio, McQueary will stay 'as long as it takes'.
'Person of interest' Tammi Smith will appear at Maricopa County Superior Court on February 8 for a Status Conference. She was arrested on charges of Conspiracy to Commit Custodial Interference, Custodial Interference, and Forgery in connection with the missing Baby Gabriel case. The Custodial Interference charge has since been dropped and Smith is out of jail on a $15k bond.
Smith's Initial Pretrial Conference is scheduled for 8:15am on March 9. Police say they no longer believe Jack and Tammi Smith are withholding information as to Baby Gabriel's whereabouts. At 4 y/o my daughter could count to 29 & to 100 by tens, write her name, recognize most letters, tie her shoes, play checkers, had her own computer w/ games, play card games, front and back flip off a spring board, jump off a 5m platform, swim 100+ ft, & much more.
Children are not bargaining chips or pawns to be used in an unhappy marriage. Poor kid.
