Baby Wyatt Garcia- Judge Lemkau May Lose to James Hosking Over Murder of Katie Tagle Son
The Three-Judges Fiasco. Judge Debra Harris, Judge J. David Mazurek, and Judge Robert Lemkau ignored in three separate instances the desperate petitions from Wyatt's mother, Katie Tagle, for 'Prevention of Domestic Violence' and for an emergency restraining order that would have changed unsupervised visitations for Wyatt's father (Tagle's ex-boyfriend) Stephen Garcia into supervised visitations. But in December 2009, Harris deemed Tagle a liar and denied the petitions. In mid-January 2010, Mazurek followed suit.
On January 21, Lemkau also deemed Tagle a liar and denied her petitions. In effect, there was no court hearing that day because the judge's mind was closed. "Judge Lemkau not only ignored the fact that Mr. Garcia had made death threats against Ms. Tagle and her son by phone, e-mail, texts, suicide letters and even a short novel ['Necessary Evil'], but he also told Ms. Tagle that she was lying," wrote James Hosking on his website.
Ten days after Lemkau summarily dismissed Tagle, baby Wyatt was dead. Garcia shot his son on a lonely road in Twin Peaks California and then shot himself. The homicide and suicide were pre-meditated. Garcia himself created and assembled all the evidence of his premeditation long before he carried out his monstrous deeds.
The grain of good in the tragic end to a beautiful thriving baby boy. SB County Deputy District Attorney James Hosking is running for Superior Court Judge against Judge Robert Lemkau. Voters will decide between them on Election Day June 8, 2010. Hosking had not yet planned to run but after reading about Wyatt's murder, he decided he would run 'based in part upon being outraged by his [Lemkau's] ruling that allowed this baby [Wyatt] to be murdered by his psychotic father'.
"The People of San Bernardino County deserve a legal system that reviews all the evidence available and protects its citizens," states Hosking on his website. Hosking received his Juris Doctorate from Loyola Law School, one of the U.S.'s best graduate schools according to U.S. News & World Report. In 1999, he became a Deputy District Attorney for SB County.
Judge Lemkau was appointed the SB County Superior Court Judge in 2007 by Governor Arnold Schwarzenegger when a new law opened new judicial seats in California. It is an ironic fact that Lemkau, before his judge appointment, was a prosecutor for the SB County District Attorney who for thirteen years concentrated on crimes against children.

There needs to a memorial at the Victorvile court house with Baby Wyatt, Jason Wayne Bumpus and the other dead children at the hands of many rogue judges like Lemkau, Kamansky, Jaffey and other judges, politicans and priest in San Bernardino County.
When I heard about this race, I wanted to learn more on my own - instead of listening to all the internet debaters (not that you're not all very entertaining). I looked at both websites for both candidates.

James, my understanding is that there was one photo and that it is phony. It first surfaced in 2006 during the Melinda Duckett tragedy and has since been circulating about the Internet.
Not to defend the Judges' actions because as a civil servant he needed to actually listen to BOTH sides, but the photos that Katie sent to her Ex was kind of severe. Sexually servicing a new boyfriend while writing "Wyatt has a new daddy" doesn't seem like the act of a friendly, honest citizen. He dismissed her because she seemed crazy. Pity the idiot couldn't trust his gut feeling and actually LOOK into the matters.
Apologies should not be accepted. An "I'm sorry, I didn't know" is not acceptable after letting a father kill his son. He was told, but he refused to accept the truth. AND he wanted to punish Katie Tagle! What nerve! Read the transcript of what Katie Tagle tried to present and how this callous man in the black robe ignored her and treatened her! All three judges should be removed from their benches as they all allowed this to happen, they enabled a man to murder his son. They don't lose sleep over any of their unethical rulings. They're used to ruining children's lives. They are a disgrace. Dump the whole lot of them that have major complaints of bias and unethical conduct.
May lose his seat during the next election? WHAT!?! He's still sitting on the bench deciding the fate of other babies????
HEREIN LIES THE PROBLEM - no consequences.
All three of these sorry excuses for judges need to be tried in a criminal court of law as accomplices to the murder of baby W
The community needs to be made aware that it was not ONLY ONE judge, Lemkau, who made poor decisions regarding Katie & Wyatt, but there were THREE: Judge Debra Harris, Judge J. David Mazurek, and Judge Robert Lemkau. They should ALL be duly confronted. Also, this is not a one-incident problem, it is a generalized problem with the Family Law courts of our state. Fortunately, not all judge's poor decisions create deaths of innocents, but there are many families out there hurting deeply in many other ways from the poor decisions of our Superior Court Family Law judges. Let's not be rash and hurry to replace Lemkau with whomever shows up first. We need to choose a judge who has the ability to "read" people and also know what can and cannot be done in the many varied situations wherein a sociopath is involved. It is follish to make that decision, as if ANYONE who happens to present is better than Lemkau. Not only could the next one be as bad as Lemkau or Harris or Mazurek, but could even be
read the transcript! it is horrifying to know this is what you are up against when you are trying to protect your child!

It is ironic that a MORMON judge sentenced a 9 MONTH OLD INFANT TO DEATH without so much as a hearing on the facts, when a TYPICAL CONVICTED MURDERER will cost the judicial system over $5 million dollars and an average of 14 YEARS to finally EXECUTE.
What did Judge Lemkau have on his calender that day that was more important than protecting the life of an innocent child.
WE PROTEST CAPITAL PUNISHMENT ON THE BASIS THAT EVEN ONE MISTAKE WILL SENTENCE AN INNOCENT MAN TO THE GALLOWS - - THAT IS EXACTLY WHAT JUDGE LEMKAU DID IN THIS CASE.
THERE IS NO "SECOND CHANCE" FOR THIS BABY - NEITHER SHOULD THERE BE FOR THIS SAD EXCUSE FOR A JUDGE.
HE SHOULD BE REMOVED FROM THE BENCH NOW!
How tragic. I heard of this on the news. These judges need to be disbarred or whatever happens to judges to lose their ability to judge anymore. I believe they are just as guilty as the murderer, himself. They helped to pull the trigger on them both.
