Banning Things in Public Places: Smoking | Cell Phones

I'm going to play devil's advocate here since the vast majority of people will vote no on this topic. I don't smoke nor do most of my friends and family. However I wanted to touch up upon the definition of smoking. This is because smoking doesn't only apply to smoking cigarettes. What about people who smoke medical marijuana?

Personally I can't stand the smell of cigarette smoke and I don't appreciate the negative effects upon my health that these smokers are computing to. However, in broadening the definition of smoking at the people should be able to smoke legalized marijuana. I think marijuana should be legalized and it should be allowed to be used in various public places. This may sound contradictory but I think it would be okay to ban cigarette use in some public places. As far as I know cigarettes don't have any medicinal value but marijuana does.

To broaden the concept of smoking further how would smoking laws apply to the use of vaporizers or water pipes? Smoking laws should not be a one-size-fits-all proposition. I see the need for banning cigarette use but not for banning someone from smoking a joint. This is especially true if the person is suffering from a terminal disease and needs its use to reduce the painful symptoms.

Banning cell phones in public places:

Cell phones should not be banned in restaurants. Most of us would not hesitate to pick up her cell phone during a meal. I think most of us would have the common courtesy to speak in a quiet tone once we are on the phone. Now we can make a distinction between those who are inconsiderately loud on their phone and those who are tactful and quiet in the presence of others. Restaurant owners have a right to ban people who are disturbing other customers for any particular reason. Therefore, adding another law banning cell phone use outright would be inefficient.

I have heard that there is technology that can stop the signal of cell phones. If this technology is advanced enough restaurant owners or owners of other private businesses can simply turn off the ability for people to use their cell phones in this vicinity. However, this would cause problems for people who need to answer their phone due to an emergency or who need to make a call for one.

Lastly, I think very few people would follow the law in the first place. It would be almost as if they're trying to outlaw people from talking to each other at the dinner table. There are some justifications for banning cell phone use in situations such as crossing the street or operating heavy machinery but banning its use in the restaurant is unnecessary.
