Barbie Vs. Bratz Lawsuit: Ludicrous?

A Lawsuit Over Whether Bratz was Created by MGA or Mattel

With the recent lawsuits of Sprinkles Vs. Famous Cupcakes and now Barbie Vs. Bratz, it seems that large companies are arguing like children in kindergarten. Do the rights to the Bratz dolls belong to MGA or Mattel? The argument over the proprietary rights of Bratz and Barbie dolls sounds more like an argument during child's play in kindergarten.

I am not a judge or a lawyer, but I did once work at a daycare. It seems to me that the role of a judge and a daycare worker in today's day and age might be almost the same. Mattel (maker of Barbie) sees that Bratz dolls are making huge profits (and perhaps taking profits from the line of Barbie dolls). Instead of trying to come up with a competitive product (tackling the challenge) that might beat the Bratz dolls, Mattel decides to file a lawsuit. During the lawsuit, Mattel says, "It's Mine!" and MGA argues back, "No, it's mine." The Sprinkles Cupcakes vs. Famous Cupcakes seems to be the same type of argument.

Mattel says, "It's Mine, I'll sue."

MGA replies, "No it's ours. We'll see you in court."

The court date arrives.

"It's Mine", Says Mattel. "No, It's mine." Says MGA. Then the constant and well publicized argument (lawsuit) goes something like this: "Mine!" "Mine!" "Mine!" "Mine!" I am fairly certain I heard this SAME debate amongst kids I watched at the daycare. Can't we just grow up?! Isn't there room to share?

I admit I don't understand the ins and outs and whether nor do I know much about proprietary rights. However, one thing I do know is that as adults sometimes we never grow up. It seems that the makers of Mattel and MGA are each holding a doll. Mattel is holding its Barbie doll and MGA is holding its Bratz doll. These large corporations are in daycare again where the original debate started. "Mine!" says Barbie. "Mine", says Bratz. "No, Mine." claims Barbie again. "No, Mine.", retorts Bratz again. "You stole our idea!", claims Barbie doll company. "You're just jealous." retorts Bratz doll company. Once again the age old battle that began in daycare continues amongst adults.

However, the question really is: What are we teaching our kids?
