The War Crimes Act has provisions that severely punish anyone who goes against the standards of the Geneva Convention. There are crimes that can be committed that can be punishable by death. The bill that President Bush is pushing through Congress will change many of these penalties.
If it were to be found in the future that President Bush or a member of his Administration committed a crime by allowing detainees to be tortured or killed, they would be tried under the War Crimes Act since the crimes would have preceded the new bill. This would mean that whoever committed the war crime could face the severe penalties, or even be sentenced to death.
In the past, President Bush has stated that no member of his Administration, or himself, have committed any crimes that would conflict with the War Crimes Act. If this were true, why would he need to put this provision in his bill about the treatment of detainees? If no crime was ever committed, why would he need a pardon provision?
For the first time in history, a President is doing what he can to make sure that he can pardon himself of a crime. This is another example of the Bush Administration trying to use the laws in the United States to their advantage. It is also another example of the Bush Administration of trying to rewrite the law so that they can cover up issues that could come back to bite them.
Recently, the Supreme Court ruled that any person who was detained during the War on Terror qualified for the protection of the Geneva Convention. President Bush has realized that he needs to push this bill through while the Republicans have a stronger hold on Congress. President Bush knows that the swing away from voting Republican will continue at least through the next Congressional Election.
It is a sad day in American history when we have a breakdown in the Checks and Balances system that was set up by the Fathers of the Constitution. The Congress is backing the president in his push to cover up his own crimes against humanity. We have had millions of people die for a Constitution that our government refuses to uphold.

Post a CommentL., you said "President Bush['s] bill in Congress," & "why would he need to put this provision in his bill about the treatment of detainees?" Hate to ruin your fun there, but Congress originates legislation, not the President. And if this law is UNCONSTITUTIONAL it will be struck down by the Supremes. If not, then you're just lettin' off steam eh? January 2009 is 16 months away and Bush will be gone. Relax. Take a deep breath.
