You have to have a business name. The name of your business should be something that easily located on the internet if you plan to sell products and services online. You should also register the name of your business because this will keep down any confusion if another business with a similar name uses your business name. Registration of your business name helps consumers locate the owners of a business if there are disputes or in the case of litigation.
Always prepare a partnership agreement. An agreement of this sort is important because it specifies exactly what the decision making capability of each partner is. It also helps designate the percentage of ownership each partner has. When you start a business some partners will act in different capacities and some will contribute different amounts of cash, property, services and other assets. All of this information should be outlined in the partner's agreement. If you don't have a partner's agreement some states will have a standard partnership agreement which is basically an agreement used for all partnerships. This type of agreement may not be suitable for your business that's why it's always good to have one tailor made just for your business.
In some businesses one partner can make major decisions without the approval of other partners. That's why you should really know and understand your partners ability, strength, weaknesses and other capabilities. If you do not want this type of arrangement you need to specify it within the context of your agreement.
Always design a business plan which basically outlines everything that has happened or is going to happen with your business. The business plan should list the qualifications of each partner. Your plan should explain what your advertising expenditures will be for the next five years. You need to explain who your potential customer is as well as the products and services you will be selling. Everything needs to be in black and white. A well thought out business plan will help you secure the capital you need to get started now and for future growth and expansion.
There are certain licenses and certificates you will need to obtain in order to business in certain states and counties. Not having the correct certificates can lead to fines, penalties and even lawsuits.
Sometimes you cannot possibly foresee everything that is going to happen with your business. If one partner dies your business will have to cease operations and close down. In order to continue doing business you must open a new business. There is a lot of planning that goes into starting a business you may want to seek legal counsel or the services of an attorney familiar with businesses and partnerships.
