Is Same-Sex Marriage Legal?

It has been a long time coming. The process for California to figure out if same-sex marriage is legal or not has gone back and forth like a ping pong ball much to the frustration of same-sex advocates and concerned citizens for equality.

History

The status of same-sex marriage in California changed on June 16, 2008 when the state granted marriage licenses as a result of a ruling by the Supreme Court of California. This was based on an equal protection argument. It lasted until November 5, 2008 when Proposition 8 a.k.a the California Marriage Protection Act, a ballot proposition and constitutional amendment in the November 2008 state elections was passed.

Added to the CA Constitution was the provision that only marriage between a man and a woman is valid or recognized in California. This overrode parts of the ruling of In re Marriage Cases which gave credence to same sex marriage.

Not surprisingly some of those against Proposition 8 included John McCain, Newt Gingrich, Tom McClintock, the Roman Catholic Church and organizations such as the Knights of Columbus.

Equality for All was the lead organization opposed to Proposition 8. Others included President Barack Obama, Barbara Boxer, and the Anti-Defamation League. In fact Jewish people living in Los Angeles were the largest religious contingent in L.A. to oppose Proposition 8. For those of you living under a rock Chelsea Clinton just married a Conservative Jew.

Today

On August 4, 2010, Chief United States District Judge Vaughn Walker ruled that the ban violated the Constitution's equal protection clause under the 14th Amendment

Proposition 8 lawyers are expected to ask the 9th U.S. Circuit Court of Appeals to review the ruling.
