California's Cell Phone Policy: Are the Police Immune to This?

If not everyone is aware of California's new cell phone law, you should be. This law took effect on July 1, 2008 . The first one(Vehicle Code (VC) §23123) prohibits all drivers from using a hand held wireless telephone while operating a motor vehicle. Motorists 18 and over may use a "hands-free device." Drivers under the age of 18 may NOT use a wireless telephone or hands-free device while operating a motor vehicle (VC §23124). It is why all the electronics stores have such big sales on bluetooth hands free kit. This was even all over the news and it was such a big deal.

We all know how distracting talking on the phone while driving is. I even bought a car with bluetooth capabilities so that I don't have to remember to put my bluetooth device on my ear every time. I wonder if the same people that are supposed to be enforcing this law follows it? I don't think so! As I was driving in Concord, CA the other day going home from work I saw a couple of police car that are on the same route that I was going. The first car was behind me driven by a male officer and the second car was on my right side driven by a female officer and she was on her cell phone! I was confused and disgusted that this officer who was supposed to be enforcing the law and keeping the public safe is doing this. She broke the law and put everybody in "harm's way" by getting distracted by talking on her cell phone. So then, I thought maybe that the other officer will report her because I saw him typing something on his computer while we were waiting for the light.

I hope that he had the sense to uphold the law and protect the public. Maybe she was just one person that chose to ignore the rules, then again today I saw another officer on the Freeway talking on his cell phone. If the public is being reprimanded for not following the law, are these police officers above it? Maybe for some people it is just a small thing but if the government took the time into passing this as a law here in California I think that it is big enough for people to understand. It is simple, do not talk on your cell phone while you are driving if you do not have a hands free device. Is there anything that the public can do to report these police officers? If they are watching us, who is watching them?

  • I agree they should NOT be able to use the cell ph5/1/2009

I was told by a police office that our Govenor said law enforcement are able to use them while on duty or at any time. Talk about controdiction ! Police usage of cell phone I have personally seen so much s%$# on them that I felt like reporting the stuff that they think they are getting via text messages! Lots and Lots of hard core porn! even acts of beastiality I was told beastiality is against the law here in california punish up to 6 months in prison but yey police officers turn there heads and have codes of silence they don't snitch on eachother Remember it's to protect themselves and serve their own intrests. Don't get me I believe in centerians if they are worthy of the badge!
