I hate to beat a dead horse when it's down, but I do love a winner. The winner is Texas; the dead horse is California. Again.
Keep out of court
Chuck Norris, the rugged tough guy of Hollywood fame, showed business savvy and common sense in a losing situation. A silly argument between two women could have crippled his family restaurant business in California. It didn't. He settled the frivolous lawsuit out of court, choosing to pay a little rather than to risk losing a lot in a case he wasn't involved in at all.
His Wall Street Journal article, co-authored with Stephen Demaura, told of the ridiculous blame two women placed on his restaurant for housing the ladies room where their ridiculous argument erupted. It told also of our litigious society, where blame is wrongly placed to avoid accountability and make big bucks while finger-pointing elsewhere.
Tort reform
The California tough guy's piece also told of tough Texas Gov. Rick Perry's tort reform. Perry signed legislation that would end such wrongful lawsuits. The loser pays all. This means that the initiators of frivolous lawsuits who lose their case will pay not only damages but also the defendant's legal expense. This has the effect of reducing such get-rich-quick lawsuits and protecting the livlihoods of those falsely accused. And it took Rick Perry's Texas to lead the way.
Out of the way
Texas is the leader of more things than political. It is, however, its elected political leader, Gov. Rick Perry, who shows the way to business and personal success in the state. Simply put, he gets government out of everybody's way. He gets it out of the bedrooms, the homes, out of the hair of people and their enterprises who just want to conduct their lives themselves.
Without the interference of government running--perhaps ruining--lives and courts settling false accusations, people are free to decide, determine, and direct their own affairs. Nanny government doesn't exist in Texas. And no court in the state will fill your bank account from a frivolous fight in a ladies room. Perry's tort reform showed the winning way yet again.
A model state
Texas has already been recognized as a model for pro-business climate, jobs opportunity, low unemployment, and now tort reform. No wonder there's a wave of folks out of California headed there. No sense in beating a dead horse in California when you can win in Texas.

Texas leads the nation in capital punishment and in the number of people without health insurance and comes in #45 in the number of people who graduate from high school. Of course, education gets in the way of the Republican agenda, anyway.
