Who gave the government the authority to interfere in individual choices in such matters, and where is it in the state and federal constitutions that give them such authority. Now, I know there will be some of you who believe that 'the end justifies the means,' but that is not how our system of government is set up, but there is a Bill of Rights at both the federal and state levels. Traffic regulation and control are one thing, dictating personal choices and behaviors that harm no one but yourself is another......nor is it their duty to cave in to the insurance lobby in order to garner them more 'profit.'
No matter what the 'benefits' of such federal legislation (and threats to the state's if they do not cowtow to their wishes) would like to know where in the federal and state constituiton the government has any authority whatsoever to 'babysit' American citizens or remove their 'freedom' to make such a determination in the use of their own private vehicles. The 'general welfare' clause does not cut it - as the 'general welfare' clause is really no 'clause' at all - simply a 'declaration' of what the 'intent' of the Constitution actually is, after all.
This is not a governmental function, and those 'laws' are being enforced for tax revenue and insurer profits most of all, and done at the behest of the insurance lobby and the NTSC (as are the over the top, now, DUI laws throughout the country - and unconstitutional search and seizure 'sobriety checkpoints.') Those insurers were not satisfied and content with mandatory insurance laws, but are clearly attempting to use their financial power to sell policies, collect revenue, and reduce their risk and losses through these illegal laws.
The NTSC is another federally funded wacko program also not a federal 'governmental' function under the U.S. Constitution, only providing funding for the federal highway system, and regulating truckers using those federal highways to transport goods within U.S. borders. The state's using the 'threats' received by the federal government in passing these laws as an 'excuse' also is pretty lame. If the feds make such threats as withholding federal funding unless the states cowtow to their edicts in areas they have no legal authority to do, then the states can sue them for the sums they are using under RICO statutes as 'threats under color of law' and 'breach of contract,' and get those sums they are legally mandated to provide under our Constitution.
No wonder the U.S. citizens, each and every year, are getting more and more fed up and dissatisfied with their local, state and federal governments. We've got fascism and tyranny here, folks.
