Early Release for Prison Inmates in California - A Solution to the Overcrowded Prison System?

California has the largest prison system in the United States consisting of 173,000 inmates, which is more than the state system is designed to hold. This over population is proving to be unsafe for the prison guards and has even been the cause of some inmate deaths. A federal judge has given California officials six months to reduce the inmate population.

Governor Arnold Schwarzenegger is trying to transfer over 2,000 inmates to prison systems in other states. Also, Governor Schwarzenegger is planning on introducing a plan to start a building program in January, even though a similar plan was denied by state lawmakers this past October.

Some officials are suggesting that six months will not be enough time to reduce the prison system in California to its optimum capacity. The inmates' attorneys also believe the prison system will not be ready in six months.

There is a solution if California is not able to transfer enough inmates within the six months. That option is to release some of the inmates early. The law does permit the early release of inmates, but only if a three judge panel, which has yet to be created, determines that early release is the best option. US District Judge Lawrence Karlton has postponed the appointment of a three judge panel because he has seen the improvement Governor Schwarzenegger has already provided.

Hopefully a decision is decided on that does not involve the early release of inmates, especially since inmates rarely have to serve their full sentence anyways. Though the cost to build more prisons is costly, it is something that should be considered before any other option. The reason is because transferring the inmates will just cause overcrowding in other states' prison systems and will just prove as a temporary solution to the overcrowding in the California prison system.

California is not the only state with overcrowding issues in their prison system. Matter of fact the entire United States is operating well over their design capacity, and so something needs to be done to fix not only California's prison system problem, but the prison system of all states in the US.

  • Early release for inmates in my opinion should not be an option

    i need help my financee is serving 4 year at donovan state prison for an acomplisment of an armed robbery. he has 2 year and 10 months to go. do you think he can get out earlier on parolee or something. someone please let me knoee im qoinq crazy trying to figure this out .

    my soulmate was convicted of a nonviolent crime never in his life was convicted of any crime. clean record a family man we have two beautiful children. he was sentence to ten years. he is a good father good husband. i collected 125 signatures in his behalf and 24 letters in his behalf and still recieved ten years this is in florida he will be there ten years at the cost of taxpayers of 30,000 dollars a year. $300,000 total for ten years for one person.Yes tax payers because we pay for this. this is unfair.i feel that if your convicted of a non violent crime first time offense punishments for this should be parole ,required educations classes, state fees, house arrest if they have a stable family to go home to, community service and even as wife i agree some prison time but not ten years this is costing us to much. he will do ten years and i as a wife and his two daughers will wait for him he is not the only one doing time we are. just an example of where my taxes your taxes all citiz

    my son is in prison got 5yrs. for hitting his girl friends mother she hit him first she was drunk and confussed shes built like a man look like a man so he defended his self and hit her and my son got five years chris brown and mel gibson had money and got no time i wish my son had money, can anyone help us? obama any one what can i do to get him out of the he is sorry he never hit real girls oh he married he's girlfriend in the courts by the judge that sentence him and the mom was there and i the same day he went to prison the mom was there ........ how wrong is this..

    This is what I do know. A guy I know did 8 years for murder. He's out now. Someone else I know got a third strike for theft. Each prior strike was non-violent. He's been in prison over 15 years. He'll die in prison. Tell me that's not wrong.

    Perhaps you should ask the 2 police officers who were shot in the Valley by an early released ,Mexican gang memeber, if this early release is working out

    Looking at all the changes CDC has gone through since I left them 35 years ago makes me really happy that I am no longer involved with that system.
    I am long since retired from the private sector and wish all the staff and inmates the best of luck in their futures.
    Just try to be constructive in your doings while inside and life doesn't have to be as harsh as I made it for myself and the convicts I dealt with on a daily basis...

    Im an ex-convict who has been out working hard to make myself a normal member of society after serving a three year sentence for a crime i didnt commit in the first place anyway i got out in 2006 and finished parole in a year and a month im trying to be a good guy but the sytem still keeps a hold of u even though you paid the time...u never really stop paying your crime because they always keep that pressure on you just waiting for u to mess up to send you back for something so petty thats why we in a big deficit now because all they care about is getting tax payers money not about our families or our lives its all about money in this country and thats the saddest part of it all!!!!!

    just another side to the reality my husband has been out of trouble for nearly 3 years having to leave the county he was from in order to get healthy. he found a job wanted to start up child support payments and we married a warrant from 3 yrs back (being in poss of two pills not his) came up when he tried to reg as a drug offender in our town and they arrested and OC sentenced him to 16months in state prison. Now who pays the price for such a low level offense? We do his wife and children I am unemployed he was the bread winner and my world is falling apart because WE TRIED TO DO THE RIGHT THING

    I believe inmates should be kept where the judge sent them to serve their time. Besides, what will be of their aftermath? They may, yet again commit another nonviolent crime to be pardoned. Not only will they try this method, but so will newcomers. Do you see this cylce? I do. Therefore they should be kept inside.

    they had started releasing county inmates to cut the budjet, when the release should have started with non violent 3 strikers, the county inmates just went in a revolving door, what lesson was taught to them, with me working in public transportation i saw the inmates being release at the same time saw them back into the drug areas. the 3 strikers have already had a rude awaking, i think if you ask them, would they think twice about there actions they would have a different perpect on life and the law. there eyes have been open, i agree with the military for violent affenders, would diffinetly help the budjet, no money paid out just there freedom when war has ended. i hate that i had kids there life and there kids life have no promising future
