Elizabeth Johnson Questioned Logan McQueary's Paternity as Document Shows

Parentage Testing May Be Necessary to Settle Johnson's Paternity Issue

Why did Elizabeth Johnson, the mother of Tempe Arizona baby Gabriel Johnson, now age ten months and missing for three of them, want to have a paternity test done? A mother or the potential father usually wants a test to prove who the baby's natural father is- often to determine who should help to financially support the baby. But Johnson did not believe McQueary could support Gabriel. In her Paternity Petition (as shown with this article), she wrote of the man named on Gabriel's birth certificate, Logan McQueary, "He says he has supported us. He has not in fact. He was in jail before, during and after Gabriel was born. He lived off me, took from me, stole from me and disappeared on many occasions." Johnson went on to write that she had to quit work and school to care for Gabriel.

According to what she wrote on the Paternity Petition, (see image), Elizabeth Johnson wanted to keep Gabriel from McQueary. In writing, she requested the following restrictions: "that he never be alone with child, fear of kidnapping leaving the state." It is ironic that Johnson herself did what she feared McQueary would do. As KPHO reported, Private Investigator Ken Gamble said, based on a found 'journal' of Johnson's, she gave Gabriel to a couple in a park.

Logan McQueary maintains that he is the father of Gabriel. On December 11 2009, he filed for full custody of the baby, at Maricopa County Superior Court, in Phoenix. But according to CBS News affiliate KPHO, 'when Johnson filed court papers, she [Elizabeth Johnson] indicated another man could be the father'. She responded with her own legal action, which was to file the aforementioned highly-publicized Paternity Petition. She named Logan McQueary as a potential father. There was another name of a man whom she believed to be the real father. But Johnson refused to name him on the petition because she was afraid of what might happen if McQueary out. Instead, she asked Tammi Smith to put down Smith's cousin's name Craig Cherry, as reported by KPHO. In the partial publicized Petition shown with this article, Johnson wrote, "Subpoena for DNA/Blood Test to establish paternity, as well as a drug test. Logan has been an addict and drug user."

Johnson had wanted Tammi Smith and her husband Jack to adopt Baby Gabriel- to give the baby a better life, she said in a taped interview with KPHO. Since Johnson was not trying to prove who the father was and simply wanted to disprove that it was McQueary, the second name didn't matter so Tammi Smith simply jotted down the name of her first cousin Craig Cherry as the other potential father on the Paternity Petition. This is the reason that Smith has been charged with forgery. After being found out, Smith admitted that her action was wrong but she was trying to help out Johnson and time was running out that day.

The day was December 14. Smith drove Johnson to the Maricopa County courthouse in order to file the petition. The next step, which never happened, was to have genetic parentage testing done. And here is where Johnson believed that the testing would have proved that McQueary is not the father. And if he were not the father, then he would not usurp her custody over Gabriel and gain it for himself. And Johnson could do as previously mentioned, give Gabriel up for adoption by Jack and Tammi Smith- rather than to do what she did... run away with Gabriel.

Yet, on December 17, when Johnson and McQueary appeared together before Judge Michael R. McVey for a child custody hearing, the court found McQueary to be the natural father of Baby Gabriel- without requiring a paternity test. I have possession of this document. On the day after the declaration of McQueary as Baby Gabriel's father, December 18, Elizabeth drove out of Tempe, Arizona with Baby Gabriel in her grandfather's 1995 Oldsmobile Delta-88. She reached San Antonio Texas on December 20 and checked into the HomeGate Studios & Suites at 10950 Laureate on the Northwest Side for the week of December 20 through 27. Baby Gabriel was last seen, with his mother, on the day after Christmas, December 26. (All of this was reported by several news media outlets including CNN. Nancy Grace's transcripts give details).

As of this date, Baby Gabriel is believed to be alive but remains missing. Johnson sits in an Arizona jail on a $1.1 million-dollar cash-only bond on several charges, including kidnapping and child abuse. The couple to whom Johnson said she gave Baby Gabriel to reportedly told her that in a few years, Baby Gabriel will look different. In other words, no one will recognize him.

Johnson became pregnant around August 1 2008. Baby Gabriel, who was born on May 3 2009, was conceived in Arkansas according to Johnson's grandfather Bob Johnson. However, Elizabeth Johnson and McQueary were living in Arizona at the time of the baby's conception.

    I personally believe that Elizabeth had no idea of who the man was she tango'd with. Things always seem better in a clear light. It is those with blinders on who choose not to see.

    Maybe Logan believed in Elizabeth. Maybe he had no idea she was a run around as well as a nut case.

    A DNA test was requested long before now, it's common knowledge that any Tom,Dick, or Harry can sign a birth certificate. I'm sure if Logan had taken a DNA test those results would have been flashed all over tv instead on the birth certificate. If he's sooo certain than agree to the DNA. Bottom line...if Elizabeth Johnson goes into the courtroom tomorrow and claims that Logan is not Gabriels father...than he WILL be taking the test! I just hope logan finds the time to attend this hearing, he sure hasn't been present at any of the others!!! That would be the first place I would be if my child was missing...in the courtroom with the abductor!!!!

    Sorry I know everyone has their panties in a bunch over this one, but there needs to be a DNA test conducted, it's that simple. Paternity was already called into question months ago, you all weren't freaking out then. Take the damn test if you want to put the rumors to rest, any other potential father would be required to if the mother requested it!

    Logan's public statement is quite contrived. OF COURSE he is ONLY going to re-direct toward a baby pic of himself and legal documentation that he is the father. OF COURSE he is going to ALSO SKIRT THE ISSUE OF BIOLOGY AND DNA! Granted, dna does NOT TELL US WHERE GABRIEL JOHNSON IS but it DOES TELL US that Logan MCQueary is SKIRTING THE ISSUE. And IF LM IS SKIRTING THIS ISSUE HOW MANY OTHER ISSUES IS HE SKIRTING? SURELY Elizabeth Johnson can't possibly enjoy the 4x6 cell she now calls home. Surely there is a GREAT REASON REASON WHY SHE ISNT TALKING! She knows she is TOAST even if there is never a murder charge. So why doesn't she talk? hmmmmmmmmm......My bet is that none of us know crap. Logan goes thru P.I.'s like a hemorraging woman goes through maxi pads and all to no avail. I would have appreciated Logan's piece to the press on him being the father if he would have also offered to do a DNA test. How hard is it? Police already took all the belongings of Gabriel from the trailor. They

    Elizabeth requested a paternity petition, if Logan is so sure he is the father he should not have any problems agreeing. Would solve the rumors and speculation about him once and for all. As for his name being on the birth certificate that doesn't prove anything. And this new baby photo as proof? Come on, take a test.
