Brian David Mitchell was kicked out of court on Monday, November 1 in Utah for singing during jury selection. Mitchell, 57, is on trial for kidnapping Elizabeth Smart in 2002, holding her captive and sexually assaulting the then 14-year-old for nine months. Smart was eventually found at the end of the nine month period approximately 18 miles from where she had lived.

After singing hymns "softly" this morning in court, Mitchell was removed and now will have to view court proceedings via video.

It's been eight years since Smart's ordeal occurred and finally, Mitchell was found competent to stand trial in Federal Court by Judge Dale Kimball on March 1, 2010.

Wanda Barzee, the other party who was involved in Elizabeth's abduction, chose to plead guilty on November 16, 2009 as part of an agreement with prosecutors and received a 15 year sentence in federal prison.

In the meantime, Elizabeth Smart has moved on with her life as best she could and just flew back from Paris where she is participating in a Mormon mission. Her father, Ed Smart, told People that, "Elizabeth will be glad to see it all coming to an end. We'll all be there to support her in court. This whole thing has dragged on ridiculously long."

Additionally, Smart traveled to Washington D.C. in 2008 to help present a book 'You're Not Alone' which also includes written entries by four other adults who were recovered. The book was published by the U.S. Department of Justice and more information about it is located here.

Smart has been in Paris, France since November 11, 2009 on her full-time mission for The Church of Jesus Christ of Latter-day Saints.
