A false domestic charge happens when someone is wrongfully accused and charged with an act of domestic violence. How can this happen? Most often, it happens when a female is the aggressor, she abuses her man and when he reacts by restraining her or even hitting back she becomes the victim.
Domestic violence charges and arrest are made all the time where the man is innocent. In many relationships, women are abusive and some men take the slaps, scratches and shoves until one day they lose control and react. No one is justified in abusing another; it is wrong no matter who is the aggressive party. However, it is unfair to men when they are falsely accused of domestic violence. And it happens more than you might think.
There are many cases where a man tries to restrain a violent woman by holding her arms or otherwise limiting her movements that result in bruises or scratches. When this happens and police arrive at the scene it usually does not matter how many scratches or bruises the man has, he will more than likely be arrested and charged.
Do police care about what really happened? That is a very hard question to answer. It seems that the laws have more protection and resources for women when it comes to domestic violence cases. Because a man is physically larger and stronger it is common for him to automatically become the aggressor no matter what occurred. This leads many a men to become frustrated and angry as they try to explain what happened.
What about the woman who file a false police report? That is illegal, right. Yes, and many abusive women are aware of this, but they also know that most people find it hard to believe that a woman can be abusive; especially if a man is a lot bigger. Women who are guilty of being abusive know that they can be charged if the truth came out so they lie. The law is clear, assault is assault.
Will we ever see a decline in the number of false domestic violence charges, it is highly unlikely until we stop judging an aggressor by their size or gender. We have to create a system built on the facts. The laws and system has to change, in determining who is guilty of a crime when it comes to domestic violence it is not enough to simply assume that the man is always guilty and the woman is always the victim.
