Federalization Debate

Stephanie Alford
I am against federalization because I agree with the statement that federalization overwhelms the federal courts with cases that are more than capable of being handled in state courts. I don't think that the federal government should necessarily expand its involvement in criminal justice; it should focus on the issues already considered to be federal offenses and let the state courts handle the rest. Whenever new crimes arise, then both of the courts could arrive at the decision as to which court should handle those specific crimes. Whenever the federal court focuses on less serious offenses, they exhaust their resources that could be better used for more serious crimes. Also, federal courts are more apt to impose harsher punishments for less significant crimes than the state courts would, which would inevitably raise the amount of money that comes from taxes in order to keep prisoners in jail longer, support capital punishment, etc.
