Gruesome Abortion Case Results in Millions Awarded to Mother

A woman whose baby was born alive with many disabilities after an attempted abortion has won a large settlement case against a well-known abortion doctor with a history of alleged offenses.

James Scott Pendergraft IV was ordered by a jury to pay over $36 million in civil and punitive damages combined to the plaintiff.

Another abortion doctor, Randall Whitney, who has his own history of court dates related to charges of abuse at Pendergraft's clinic, was called upon to testify, reports Physicians for Life.

The court case this week stemmed from a 2004 attempted abortion with a lawsuit in 2006: C.H. Individually and the Center for Special Needs Trust Administration vs. Randall B. Whitney, M.D., James Scott Pendergraft IV, M.D. and the Orlando Women's Center (Case 04-CA-1202, Orange County, Florida).

Although the updated documents to this case are not yet available, the 2006 courtroom documents expressed the following claims against the doctors and clinic, among others (paraphrased points):

* That the woman was not examined by a licensed physician prior to the procedure to determine the gestational age of the fetus. Her paperwork and counseling were administered by non-licensed workers.

* That an improper dosage of abortion medication was administered by a non-licensed worker with no doctors or nurses present.

* That the drugs administered were far over the prescribed dosage, including a dose of RU486 [which is often prescribed to women who will then need to miscarry or deliver the baby/fetus at home without a doctor's attention].

* That the woman was ordered to go home from the clinic while she was in active labor after the drugs were administered.

The woman ended up calling 911 from home and delivered the baby at a hospital. The baby, now a child, suffers from chronic debilitating illnesses and needs special care. That's where the Center for Special Needs Trust Administration comes into play as a plaintiff along with the mother.

A jury decided Tuesday that the plaintiffs had proved their claims, awarding the settlement. Pendergraft will appeal.

Gruesome courtroom testimony

Witnesses inside the courtroom have spoken to pro-life press from LifeSiteNews.com, a reputable pro-life news organization that widely confirms its sources before printing stories. This news will not be seen in most mainstream media due to being considered too conservative in nature.

According to a Lifesite News article, Dr. Randall Whitney, Pendergraft's associate, testified about routine abortion procedures at the Orlando clinic. A witness in the courtroom stated that Whitney admitted to aborting babies over the toilet; sometimes the baby was still alive and wiggling, but allowed to die.

This wouldn't be the first location where such procedures were allowed. Jill Stanek, R.N., worked at a hospital in Illinois when she discovered that babies were sometimes alive after abortions. The babies would be wrapped in blankets, placed in linen closets or other locations within the hospital, and left to die.

Stanek eventually testified before Congress with proven evidence, and her testimony was instrumental in President Bush's signing of the Born Alive Infants Protection Act in 2002.
