Halle Berry Gabriel Aubry Split: Gabriel Aubry Wants Custody of His Daughter

Well, that didn't take long. A few days after the Halle Berry and Gabriel Aubry split story, People.Com ran another story hitting out at Aubry, declaring that Halle had "thrown him out months ago" for failing to "pull his weight in the relationship". As one might expect, Gabriel Aubry is none too happy about those accusations and he's hitting right back. Hard.

RadarOnline.com, one of the first to break the original story of the split, is now reporting that Gabriel Aubry is so angry with how he is being portrayed in the media that he is considering getting a lawyer, seeking custody of his daughter and moving to Canada. Apparently, Gabriel also believes that the attacks are coming from Halle's camp. So much for the amicable break-up I guess.

Since they are not married, it should be interesting to see how the courts will handle a custody battle. For the most part, the courts still favor the mother when it comes to primary custody of a child, especially if the child is very young. Gabriel and Halle's daughter, Nahla, is only 2 years of age.

Not to mention, Gabriel Aubry would have to prove that Halle Berry is an unfit mother, neglectful or incapable of parenting their daughter in some way. According to the RadarOnline story, the only complaint Gabriel Aubry has - outside of his wounded ego - is that he is concerned for the welfare and safety of his daughter due to the media frenzy surrounding their break-up.

I don't know. He's going to have a pretty tough row to hoe on that one. The last thing that could be said about Halle Berry is that she's irresponsible or is exposing her daughter to the paparazzi unnecessarily. She is a drop-dead gorgeous Oscar® winner who is followed by the paparazzi whether she likes it or not. But, she adores her child, is very protective of her and it shows. I would also suspect that no one knows this better than Gabriel Aubry. So, perhaps what we're really talking about here is someone feeling the sting of a break-up and looking for a little revenge.

You can't blame him, actually. No one wants to be portrayed as a dead-beat. In fact, according to those who have rallied to Gabriel's defense, he certainly is not. Apparently, Gabriel Aubry makes around $750,000 a year as one very handsome model. It's not Halle Berry wages, but at $750,000 a year, I would hardly call him a dead-beat. Besides, Halle certainly knew this when she met him. So, if she is throwing him to the curb because he was not "carrying his weight" in the relationship, that seems rather disingenuous of her, to say the very least.

But, as is always the case with these matters, it is all purely speculation. Only Halle Berry and Gabriel Aubry know what the real facts are in this situation. So, for now, let's just hope for little Nahla's sake, this isn't about to get ugly.
