Hannah Montana Fans Join Class Action Lawsuit over Tickets

A class action lawsuit filed Monday alleges that some fans that paid to join the Miley Cyrus fan club expecting to get access to tickets for Miley Cyrus and Hannah Montana live performances were left empty handed after a New Jersey fan club member's failed attempt to get tickets for the "Hannah Montana & Miley Cyrus: Best of Both Worlds" tour.

"They deceptively lured thousands of individuals into purchasing memberships into the Miley Cyrus fan club, and that's why we're suing," said Rob Peirce in a release issued today. Peirce is an attorney at Robert Peirce & Associates, P.C. of Pittsburgh, Pennsylvania who filed the suit along with attorney B.J. Wade of Glassman, Edwards, Wade & Wyatt of Memphis Tennessee.

"Thousands of people joined the club based on the understanding that by joining they would be able to purchase Hannah Montana concert tickets before they were offered for sale to the general public," said Peirce. "While the club and the website do not guarantee ticket availability, they explicitly state that members who log on shortly after tickets become available will have a good opportunity to get tickets. In reality, the vast majority of club members, including those who logged on at the appointed time or shortly thereafter, were unable to obtain concert tickets, " said Peirce.

The lawsuit seeking triple damages was filed in US District court for the Middle District of Tennessee against two Tennessee based companies, Interactive Media Marketing, Inc. and Smiley Miley Inc., in the name of Kerry Inman and anyone else who joined the official Miley Cyrus fan club based on the representation that purchasing a membership would make tickets more accessible. The suit alleges that the two companies knew or should have known that their membership vastly exceeded the number of tickets available.

Inman, a New Jersey woman, claims she logged into the site at the exact moment tickets were to have gone on sale for the "Hannah Montana & Miley Cyrus: Best of Both Worlds" tour in Atlantic City, but was unable to get them.

"The scenario that the Inman family went through -- paying for a membership, then logging on to purchase tickets as soon as possible-this scenario has been replayed thousands, if not tens of thousands of times over the past few months," said Peirce.

Hannah Montana is a popular Disney original series which portrays Miley Cyrus as Miley Stewart, leading a double life as an average girl and a famous pop singer (Hannah Montana.) Hannah Montana and Miley Cyrus have branched well beyond the small screen to include live performances, music, books, video games, clothing, fashion accessories, and a feature length Hannah Montana movie expected in early 2008.

    Why are people taking this out on her? This isnt her fault. I'm a fan club member and I would NEVER join this suit! That's ridiculous! It's stated that only 20% of the arena is set aside for fan club members so when that's out then you're out of luck. As far as the general public sales, Ticketmaster is already suing RMG. So why are others trying to cash in on this?! This is not your problem, think of how miley feels about this WHOLE situation!

    Ok...first of all I can see to a certain extent parents being upset because their kids were devastated..BUT we joined the fanclub and it is no different then trying to get them when they go onsale to the general public..it is first come first serve! Nowhere does it say or imply that everyone with a presale password is guaranteed tickets. I know a lot of people that were extremely disappointed about not getting them. Anyone who knows anything about the sale of concert tickets knows that there is NEVER a guarantee that you'll get the tickets you want. I was lucky and able to get 4 tickets through the presale and when they went on sale to the public my husband and I each were on a computer and neither of us came back with anything(because at this point we were trying for friends of ours that were not so lucky through the presale)...we just kept trying for about 10 minutes or so and then we got 4 more seats that we gave to our friends....so why these tickets were gone instantly I don't kno

    Tammy, be happy you got seats period......How bout telling my daughter how mad you are that you only have bleacher seats...she has none!! I joined the fan club in August and awaited the presale patiently. I logged on ten minutes before the presale began and clicked exactly at the moment, as soon as I cliocked it said sold out!

    I have a complaint about this on file with the website about this. i actually was in the process of buying tickets and got bumped off and lost my floor seats. i did end up with seats way up in the bleachers for the same price after logging back on in under 1 minute! how do i join the lawsuit? i was on the comuter exactly at 10a.m and lost my tickets by 10:02!

    The same thing happened to me. I paid the membership fee my daughter and signed on and got nothing. It was a $30.00 scam operation. I look forward to joining this lawsuit.
