How to file for divorce in Kentucky
Kentucky is a no fault state in divorce cases. This means that neither party is required to admit to any wrong doing in the ending of a marriage. Kentucky allows the parties of a marriage to request a divorce without admitting anything wrong. A no fault divorce lets both parties escape a bad marriage without having to air the dirty laundry in court.
Here is what you need to do if you wish to file for a divorce in the state of Kentucky.
Understand. The understanding of a divorce isn't always easy. A lawyer can help you to understand all the legal terms.
File paperwork. One or both spouses must file the paper work. A divorce can not happen if no one files the proper paper work.
Pay filing fee. Kentucky has a filing fee to file the paper work for a divorce. The fee for a divorce in Kentucky is about one hundred and thirteen dollars.
Schedule an appointment. An appointment will need to be scheduled to discuss the divorce proceedings.
File mandatory case disclosure. This will need to be filed, in order to file for the divorce. This is usually the other party's response to the petition for divorce. Courts require this to be done.
Serve spouse with the papers. This needs to be done. You can either deliver it yourself, or through the certified mail or the police department can do the dirty work for you. Never go alone if you have to serve papers to a spouse. Let someone else do it for you. You can never be too careful.
One of the parties in a divorce proceedings needs to be a resident of Kentucky for at least six months.
