Americans value freedom to a great extent and this is probably why people are willing to go out on a limb looking for it! This has led to the strong belief that you can do what you like in a country like the USA. There is a lot of truth in this belief as not many others the world over experience freedom like the Americans do. American citizens can also be privy to government records including those maintained by the courts; all under the provisions of the Freedom of Information Act.
According to American laws any citizen of the country can expect to be obliged by the specific Government department from where he seeks the records. The nature of the laws permits this so that all government dealings are transparent and open for public scrutiny and knowledge.
Like all other laws, the laws for right to information have their share of loopholes that Governments can use if they do not wish to part with the information requested. Even though the Government department concerned is bound to comply with the request, it can move to deny compliance if the records requested necessitate withholding. This is because the Government's right to decide why certain records need to be kept confidential and, therefore require withholding, as the burden of the proof is quite rightly that of the Government and not of the person requesting the information.
Governments often use several reasons for withholding information. Matters that are a national security concern and court records that refer to minors require secrecy for several valid and legitimate reasons. Cases involving children are generally kept confidential by juvenile courts. Only those parties actually concerned with them can be privy to them. This is a right and fair method of ensuring that minors are protected against any unwarranted attempts of strangers on their privacy and dignity.
There may be times when you need to have access to such public court records for a particular purpose, like getting background checks or getting details of cases that are of concern to you or just plain curiosity. Whatever the reason for wanting to obtain them, it is not worth spending a lot of money trying to obtain them. This is one reason why you require public court records that are free.
