How to Obtain a Patent in the U.S

You've invented a product and would like to obtain a patent on it. Do you know where to go from here? The process is fairly simple and you do not need to hire an attorney to do so. The cost to obtain a patent on your own is approximately $1,500.

There are three different categories for patents, utility, design and plant. After determining in which category your product qualifies, you must be sure that your product is something that has never been done before. This involves searching U.S. (and sometimes foreign) patents. You can begin your research on the Internet. You can also research with a Patent and Trademark Depository Library. Once you are sure that your product qualifies, you must have written documentation of every step taken to invent the item. Include charts, testimonial and how you came up with the idea on the product. There are many sources available if you need help. The USPTO's website has a wide array of help tips and contact information. With these steps complete you are ready to submit your application with the U.S. Patent and Trademark Office. There is a fee required with the application. After submitting your application, the examiner will review your application. If they have determined that your idea is unique, you will receive the patent. The U.S. patent office receives hundreds of thousands of applications a year. The application review process can take an extended period of time. Be patient and don't second guess yourself.

Once you have received your patent it's time to set up a marketing plan. Show the world your product and get paid for the hard work you put forth on your invention.
