How to Understand The Elements of a Sales Agreement

Many "key elements" exist in written contractual agreement, in order for it to be "legally binding" (All Business.com, 2006) between the business owner and the consumer. The agreement must be read and explained, until it is "completely understood" by both parties. In addition, the "terms and conditions" should be explained in detail and agreed upon by both parties. A "signature or e-signature" is legally binding, once both parties "consent" to the sales agreement.

Understand the Agreement

Each "agreement" (The Free Dictionary, 2008) is different, so it is important for each party to read and define the contract. They should not sign anything, until they have a complete "understanding" of its terms. Then, the business owner should make sure that the contract is "clear and concise" on it "cancellation policy" and "length of contract" (All Business.com, 2006). This will help the parties fully understand the agreement and ease any confusion about the agreement.

Retain Counsel

Before entering into any legally binding contract, it is important to "retain counsel" to explain anything that is unclear or confusing in agreement right away. Be aware of the "agreements and considerations" (All Business, 2006), because they may affect the sales agreement. Every contract should list its terms and conditions, should never be taken lightly. It is vital for the parties to seek legal counsel or the agreement may cost more than he or she intended to pay.

Knowing the Conditions

Additionally, they should know the conditions, which they must honor after agreeing to sign the contract. Always check to see if the "total price" (Meiners, et al, 2006), is the amount that the parties agreed upon in the original deal. Furthermore, they should ask any questions he or she may have before signing the agreement. This way, they understand the contract and the conditions of the agreement they are about to enter into.

Legally Binding Contract

Many contracts are legally binding and enforced by the court; whether signed in person, on the phone, or online. These contracts should be reviewed with careful consideration and/or counsel, because this will protect you from faulty deals. In addition, many contracts have "exceptions and cancellation policies" (Meiners, et al, 2006), which can "change" or "alter" the agreement he or she signed. However, minors "under eighteen" cannot sign pr entr any kind of legally binding contract

Conclusion

In conclusion, both parties should read everything and understand what agreement that they are entering into. The parties should seek separate legal counsel and know the conditions, before signing any type of contract. This way, they aren't accused of breaking a legal agreement, due to a misunderstanding or lack of understanding. Therefore, he or she should take the extra time to ask questions, since the sales agreement is a legally binding contract.
