Before September 2009, I smoked the wonderful Djarum Special clove cigarette. President Obama signed a bill that month to ban flavored cigarettes, except menthol. That does not mean I will be quitting since I am a dedicated lover of clove cigarette smoker. It does however cause much frustration for me and fellow clove cigarette smokers that have to resort to buying cigarettes online.

The flavored cigarette ban by the FDA was meant to deter young people from smoking, so why would there be regulations on importing flavored cigarettes for personal use? If you choose to buy cigarettes online I recommend not ordering more than four cartons.

The only consolation for flavored cigarette smokers is that they can legally import for personal use. Allclovecigarettes.com offers Djarum blacks (packs of 16) and other flavored cigarettes that are no longer available in the US; they express ship them for only $10. Sometimes my orders pass right through US Customs and other times, like recently, my clove cigarettes sit for over a week. After waiting too long for my clove cigarettes bought online and the threat of banning online sales, I will be stocking up.

Laws on Importing Flavored Cigarettes for Personal Use

Family Smoking Prevention and Control Act "makes no provisions that ban the import of the banned items for personal consumption, only for sale or distribution" (according to Wikipedia) but finding those words in simple black and white is impossible.

According to the Alcohol and Tobacco Tax and Trade Bureau (TTB), Treasury PART 41-IMPORTATION OF TOBACCO PRODUCTS AND CIGARETTE PAPERS AND TUBES Subpart K-Tobacco Products Importers ยง 41.190 "...Persons importing tobacco products and cigarette papers and tubes for personal use, in such quantities as may be allowed by Customs without payment of tax, do not require an importer's permit."

Only importers of commercial quantities of tobacco products need to obtain an import permit from the Alcohol and Tobacco Tax and Trade Bureau (TBB) of the Department of Treasury.

What must I do if I am Importing Flavored Cigarettes for Personal Use?

The TTB does not regulate tobacco products or cigarette papers or tubes that are imported by a person for their personal use. They defer you to U.S. Customs and Border Protection and your appropriate State government agency regulating such articles.

In my article Where to Buy Clove Flavored Cigarettes, I explained that it is illegal to sell flavored cigarettes (except Menthol) anywhere in the US; that does not mean you cannot buy cigarettes online to be imported for personal use.

According to United States Customs, the import regulations for clove cigarettes and other flavored cigarettes is: 1000 cigarettes, a reasonable amount of tobacco and 100 cigars ARE allowed. United States Customs.

    Rock on! I have suffered the same issue and finally resorted to American Spirit Menthol but I sure do miss my cloves. I was on the Sampoerna milds and they are like heaven, and I miss them. I thought all the stuff I was hearing about importing must be wrong but I finally gave up on it after the last time I ordered and the payment process was in a funk. Would love to hear if there are any updates on the laws regarding this issue since the article is nearly 2 years old.

    I do not understand the concept of banning a certain ''type' of cig. It's comparative to legalizing certain 'types' of marijuana. Agree, America is not a FREE country!!

    This is a good overview. Not sure I agree that we should be able to order online--and I'm a smoker. I would be somewhat concerned about what else is in them.

    Ranee, I used to love clove cigarettes, figuring they were more natural and just simply tasted GREAT!!!! When forced to choose between my baby and clove smokes, he won. That was 10 years ago and I still miss them, ha! Thanks for advocating, I think!

    Ugh, I am as livid as you, though I am a menthol smoker, still I find this ban reprehensible!
