Infants Dying from Being Beaten by Parents

Where was Child Protective Services at the Time of Death?

Amber Shevalier died at only one year old after sustaining massive head trauma. Mom's boyfriend fatally beat her baby to death and neither bothered to take her to the hospital. Amber stopped breathing early Thursday morning after the couple kept her awake until 12:30am and splashed her face with water because they thought she had a concussion.

Mom, Kelly Shevalier, was arrested for failure to seek immediate medical attention and was given $100 bail. WHAT? Whatever happened to failure to protect? Whatever happened to accessory to murder? What about negligent manslaughter? Have we gone mad? A baby is dead! Michael Alan Barker is being held without bail and the Department of Children and Families is investigating. What about murder one?

The Orlando Sentinel reports that the couple's other two children, ages 6 and 4, have been placed with family members and are not injured. Detectives say the children are afraid of Barker and their story is different from Barker's statement regarding Amber's death.

This happened one block from my house. This is the fourth child killed by family this year. There have been 62 people murdered in Orlando and Orange County so far this year. This year will obviously be up from 98 people murdered in 2007. What are we doing about this?

Well, let's see, Fidel A Juarez Sr. was arrested and held without bail after his infant daughter died Wednesday, June 25, 2008, of blunt force trauma. The baby was 1 year and 3 months old. When she was born in March 2007, she tested positive for cocaine and had respiratory problems. Mom is serving 14 months in jail for burglary, grand theft and obstructing an investigation.

In May 2007, when the baby was 2 months old, Dad was arrested for battery, kidnapping and committing lewd and lascivious acts on an adult. On March 1, 2008, his three children were returned to his custody with supervision. He was investigated again in April after allowing the kids to talk to their mother in jail when he wasn't supposed to allow contact. But nothing was done about it.

According to the Orlando Sentinel, their first child was born in 2000 and the Department of Children and Families as well as Child Protective Services have been involved with this family ever since. Why in the world did this man have the opportunity to kill a baby? When that much history in crime, why would he be allowed to raise his children? Isn't part of parenting to teach your children right from wrong? And if you don't parent, isn't that neglect? And isn't neglect a crime? Is it not enough reason to remove the children and place them in a safe home? Wait, they were in and out of foster care. So again, why did he have the opportunity?

What does our country...our state...our government intend to do to start protecting our children? I will be writing about the results of these two cases once I learn them. I am willing to bet, unfortunately, that they will be charged with minimum crimes such as child endangerment or neglect, child abuse, assault, maybe even manslaughter. Both were infants and died by reckless acts, all involved parties should be charged with first degree murder.

  • Murder is the unlawful killing of a human person with malice aforethought.
  • Deaths that occur by any recklessness are considered to be implied malice murders.
  • Unlawful killings without malice or intent are considered manslaughter.
Conduct with a reckless indifference to human life and conscious disregard of unreasonable risk of death or serious bodily injury is considered abandoned and malignant heart which is an element of common law murder which is at least second degree murder.
