Is it Right for Judges to Not Follow Proper Procedure when Hearing Court Cases?

Recently my wife and I had our son removed from our custody by the Child Protective Services because our 2 1/2 year son had walked out of our house and walked next door to play with the neighbor's dog, and was not supervised by either myself or my wife. The neighbor called the local police because we were new to the area and did not know where our son had came from, and had our son picked up by the police and the child protective services. Now there is a proper procedure that is supposed to be followed regarding these kinds of cases and instances however in our case this procedure that is set forth by our state laws was not properly followed. Now a month a later the CPS still has our son in the states custody and we have not even got the chance to see our son since this incident happened back in February, and the procedures by the court system has not been properly followed as set forth by our state laws.

The Child Protective Services, our court appointed lawyers and even the circuit court judge have not properly followed the law or the procedures that is supposed to be followed. At our preliminary hearing we had there was no judge present and no prosecuting attorney present but yet somehow there was an order placed in the court that stated that my wife and I had waived our right to a preliminary hearing which we did not but yet it was entered into court that we did. Now my question is this why do we have laws and procedures that judges, police officers, child protective services, and even lawyers if none of them are going to follow our procedures as set forth by our state? If anyone else has ever gone through anything like this please take the time and review the laws of your state and make sure that you are not being rail roaded by lawyers, judges, or anyone else because even though a regular person does not have a law degree does not mean that they can't go online and look up the laws and procedures in which a judge, police officer, or even a lawyer are suppose to follow and make sure that the laws and procedures are being properly followed. I myself have spent the past 12 years studying the procedures regarding child abuse and neglect cases with the welfare because I had lost 3 other children to the state welfare system back in 1997, and even with this present case that my wife and I are going through with the circuit court I have found several errors that were not properly followed by anyone in the court system. When my wife and I brought this to the attention of our lawyers all they said was oh well it isn't going to do any good to try to push the issue because the judge who is hearing the case doesn't really care if the child protective services doesn't follow proper procedure they are just worried about the well being of the child.

Now another question I have is this....... Is it right for even a judge to not follow proper procedure as set forth by our state? If a judge isn't going to properly do their job once they are elected as judge for anything then I think that they should be removed because the judges take an oath to follow and obey all laws and enforce them to the best of their abilities, but is it fair or right to have a crooked judge when it comes to cases like ours where it involves the welfare of a small child? Please if you have ever been a victim of something like my wife and I are going through take it upon yourself and look up the laws and procedures that are to be followed by your state and don't be a victim like we are and fight back because that is what we are doing to try to put a stop to having officials not properly following the laws and procedures that a judge, police officer, and even lawyers who took an oath to enforce the law. If the judges aren't going to properly do their jobs then they need to be reported to the Supreme Court and be investigated because as I mentioned before if any judge is not going to properly do their job as a judge then they need to be removed from the bar and not allowed to practice law anymore.
