Jack & Tammi Smith Explained Why Baby Gabriel Johnson Mother Filed a Paternity Petition

Standing across the street from the 4th Avenue Jail, just after her husband Jack Smith had bought her release for $15,000 on February 3 2010, Tammi Smith talked to the news media about her three felonies in connection with missing Baby Gabriel Johnson. She told the news media of her jail experience and her annoyance with the Tempe police and the prosecutor's evidence and witnesses. Then, before she talked about Logan McQueary, Baby Gabriel's alleged father, she and Jack explained why the baby's mother, Elizabeth Johnson, had filed a paternity petition. They also explained the Craig Cherry incident once again.

Tammi Smith said that it was natural for a mother to make sure that the man to whom she may have to give her baby is the real father. She said when she wrote in the name of a first cousin, Craig Cherry, on Elizabeth's court petition for paternity testing, she and Johnson were rushed- the courthouse doors were locked up soon after they entered, with Gabriel.

Logan is named on Gabriel's birth certificate. The court declared him to be the natural father without the benefit of the parentage testing that Elizabeth had petitioned for. Tammi said that Elizabeth was going to put down a fictitious name but Tammi told her that a false name wasn't a good idea. Tammi said there was another man whom Elizabeth could have named as a potential father. But she refused to put his name down. Tammi would not tell the media the reason for Elizabeth's refusal. "I can't say why. I'm not going to say why on TV but the courts will know why when I go to court," said Tammi. In this interview, Tammi ended with saying that she didn't want Elizabeth to put down a phony name and having somebody get a knock at their door one day.

Jack said the police had never asked specifically about the paternity petition. He said that had they asked his wife 'what do you remember about December 14?' then she would have recalled the petition and that she had written in Craig's name. According to Jack, the police never questioned his wife in a specific way.

Tammi smith explained the reason why she 'got involved with this person [Elizabeth]' was because she felt sorry for her. She felt that Elizabeth 'was being completely taken advantage of' by Logan and Logan's father, Frank McQueary. "I felt very, very sorry for her- that she had nobody on her side," said Tammi.

"Do you know where Gabriel is," asked a reporter. "Absolutely not," Tammi Smith replied. She said that the court knows she does not and admitted such last night. Regarding Gabriel's father, she believes he is not credible. Regarding the text messages and recorded conversations that Logan was asked to hand over by the Tempe police, Tammi said that Logan's evidence was in broken-up bits and pieces. She claimed they were doctored- cut and pasted- to look as if the Smiths had done something wrong.

Jack Smith had this to say about the messages- "We're very happy that we found out that he [Logan] did record those messages because, you know what- if you record one, he had to have recorded them all. He can't pick and choose which one he wants to play. He has to play them all." He went on to say that the messages would show that everything he and Tammi had told Logan were what Elizabeth had wanted them to tell Logan for her.

Jack also said that Logan had recorded all the calls between him and them. He said that he and Tammi had not recorded all the calls. "Sorry I didn't record every single called that we made because we're not that type of people," said Jack. He also said that he and Tammi are not constantly thinking that everyone is potentially bad. "We trust people," Jack said. Both Jack and Tammi alleged that out of a fifteen-minute call between them and Logan, only a few minutes had been played and that Logan cut-and-pasted the calls.
