Jason Burkett's "Open Letter"

Friday night, me and Perry drove towards Galveston. We stayed the night in a hotel parking lot because we did not have the money to get a room. We just slept in the Rodeo, and when we woke up, we drove to Galveston beaches, and just drove around. We headed back home, sometime, and got to my Cut n Shoot trailer, that evening, this was now Saturday evening.

We spent the night, Saturday, at the trailer, but woke up real early, and left. Perry met Megan Lazrine on Sunday morning. Sunday, we stayed with Megan most of the day, just drinking a little and "hanging out". We DID NOT do all sorts of drugs, as Perry has claimed. While in Sarah Buehler's garage we smoked two (2) joints, between me, Perry and Sarah. Megan was there, but did not smoke. I do not remember what time it was.

My days all run together, and I don't remember exactly. But, I, Perry and Sarah did smoke two joints, and NOTHING ELSE! There were no pills around. There was no acid around, NOTHING! This night I believe, we ended up at the park hanging out, and then we went to the Truck Stop, where we were subsequently arrested.

As far as what happened in the morning of my arrest, I do not remember every detail. I know that my arrest was violent and that I was shot. There are conflicting accounts of my arrest, but this is what I remember.

I woke up (I don't remember if I was shot first) and saw the cop. I couldn't hear anything, but I did see him. I knew I was "wanted" for violation of probation, and thought, "Shit, I'm caught". I remember looking at the passenger seat to tell Perry that I was going to run. Perry was not there, he was in the backseat. I don't have a clear memory of the guy who was with us, but it really didn't matter.

Perry was in the backseat, so I told him that I was going to run. There's been talk that I had said things like "Balls to the walls etc..." But, that is a fabrication. I never said anything stupid like that.

I was planning on running from the police. I do not dispute that. I don't remember my exact words, but it had nothing to do with "Balls to the walls", as reported previously.

I never said anything about any murders.

I remember starting the vehicle, and driving forward, towards the right. The officer was way in front of me, and jumped behind the trunk of his car. At no time was he ever in danger of being hit. He lied and said that he got hit, then "rolled out of the way" and shot the rear passenger tire out. (I do not even think that tire was flat) I know that there were reportedly gun shots that landed in the front driver's seat head rest coming from the front. I remember hearing shots, but don't know where the cop was. I know there were photographs that showed all the bullet holes. I have tried to get these, to compare to his deceptive testimony, with no success.

There has been claims that I had been convicted of Attempted Capital Murder of a police officer, that is false.

Under the directions of my trial counsels, I plead guilty to Agg. Assault of a Police Officer! I do not agree that I am guilty of this, but I felt it was in the best interest of my future, and my family, to accept a 15 year sentence, and get it behind me. I know that I was wrong, to run from the police. With all the surroundings of my arrest and the fact that I just barely.
