Jessica Duran and Nude Jailhouse Photos

Colorado resident Jessica Duran is suing Mesa County over the circulation of nude photos of herself from jailers to inmates while her husband was incarcerated in the county jail.

As standard procedure would have it, the jailers opened up Duran's package before it was delivered to her husband to check for any contraband. Upon opening the package, jailers found many nude pictures of Jessica Duran and apparently, began distributing them around the jail.

According to CBS4Denver.com, Duran claims her privacy and civil rights were violated. She says she is also suffering emotional distress and humiliation. Duran plans to sue for at least $100,000 and has hired attorney, Lonn Heymann.

Sheriff Stan Hilkey defended the jailers.

"There's no reason to believe we did anything wrong here" and asserts that her case is "meritless".

Hilkey claims that there has been no suit filed yet, and according to GJSentinel.com, "The commission and sheriff have yet to discuss how to treat the claim".

Personally, I think that Jessica Duran's case definitely has merit. It would be a different situation if the husband had begun the circulation of photos, but because of the fact that jail officials did it with no reasonable cause, there could be trouble ahead for the jailers of Mesa County, Colorado.

The point of looking through incoming mail is to stop contraband from entering; there is absolutely no legal reason for them to have passed around those photos. Granted, Jessica Duran should have prepared herself for the fact that a middleman would intersect the mail and discover what was inside, but the jailers seemed to have made an excessive effort to show off the personal property of Mr. and Mrs. Duran.

Some skeptics think that Mrs. Duran will lose this case based on the principal that pornography is not allowed in jail, but nevertheless, if it was in fact illegal for inmates to possess pornography, then the jail officials are still wrong because prisoners saw the pictures also. Furthermore, when a jailer finds something that cannot legally be given to the recipient, he needs to either destroy it or return it to the sender.

Whatever your stance is on whether or not Mrs. Duran deserves the steep $100,000 claim, the trial and it's outcome will no doubt be interesting. Weigh the evidence and feel free to share your opinion on the topic of Mrs. Duran's nude pictures.
