Judge Denies Order to Have Howard K. Stern Submit DNA

And the saga continues. Anna Nicole Smith's baby girl Dannielynn may never know who her biological father it, but she will most certainly see tapes of the drama concerning it. This time it was the attorneys who got out of hand, viciously attacking each other in a fierce verbal fight on live television.

Larry Burkhead's attorney, Debra Opri, claimed she wanted to expose that Howard K. Stern has been pursuing an accelerated contact agenda with Burkhead. Supposedly this agenda is trying to get the two of them to come to some reconciliation outside of court, without the aid of the attorneys. She says that Stern just talks, talks, talks, and spins stories. She is telling him to "Put up, or shut up" in regards to the paternity test. Opri is trying to cast serious doubt on Stern's paternity rights, saying if he truly believed he was the father to Dannielynn, then he would have no problem submitting to a DNA test.

Opri went on to verbally bash one of Stern's attorneys, Krista Barth. According to Opri, Barth is all talk, and doesn't know what she is talking about. Opri thinks she should go back to Florida and pay her bills (Opri believes Barth is only in it for the money), as she has had no part in anything since the funeral.

The verbal bashing transpired after Birkhead went to a Los Angeles judge on Tuesday asking that Stern be ordered to take a DNA test. While it (ironically?) was the same judge who ordered Anna Nicole to submit DNA, this time the judge said no. The judge will review the case in two weeks, after studying it more closely. Despite the setback, Birkhead's attorney Debra Opri believes the mere act of filing this motion will aid his reputation in the Bahamas. Opri does believe that the judge will order the DNA testing to be done, and predicts that Dannielynn will be handed over to Birkhead in less than a month (according to her, the test should be ordered by the 16th, and processing the test does not take very long).

It is important to note that Bahamian law favors the birth certificate and the welfare of the child regardless of paternity. Regardless of the legal outcome, the Bahamian government could decide based on who they think will provide a better life for the child; it could be possible that neither Howard K. Stern nor Larry Birkhead will be awarded custody.

In other Anna Nicole news, her personal diaries depicting her unstable relationship with her mother have shown up on EBay, the online auction giant. Other items including books, receipts, checks, and IDs are listed as well; apparently all were thrown out and scavenged from the trash.

    The World is cruel, too cruel for kind, abused people. She had a mother from hell, and knew what she was getting into. Just leave the lady to rest. Rest in peace, Anna.

    This is what the nice guy Larry Birkhead is all about. In the news last June 2006...........Anna Nicole Smith is set for a legal battle with the sperm-donor father of her baby after insisting he will have nothing to do with the child when it's born.

    The pregnant widow of billionaire oil tycoon J. Howard Marshall is also refusing to give in to the unnamed father over cash demands from her inheritance.

    A friend of Smith's says, "She's freaking out because the father wants money and access to the kid.

    "The guy agreed to get her pregnant and then vanish. Now he wants to get his hands on the inheritance money she is fighting for."

    Smith is still fighting her late husband's family in court for a $400 million share of Marshall's $1.5 billion estate.

    How naive can people be to think a drug addict makes sound decisions and is not vulnerable to those providing them with their next fix? If she died of a massive drug overdose and there are plenty of witnesses who saw HK$ inject her with them than that is MANSLAUGHTER. How likely is that two people die within a five month period with the same person around carrying the goodie bag? The same said person also stands to benefit financially from the deaths. Get a clue.

    Howard Stern is getting the blame for Anna Nicholes choices!!! Come on....no one makes another person choose to take drugs!!! It was her choice to be with him for 15 years and her choice to name him as the father....it is apparent he loved her very much....could Elvis Presley's body guards stop him from using....it's time people stopped blaming him for her choices...he is having to deal with the loss of her death and the possibility of losing a child he has bonded to and loves...give the guy a break!!!!
