Judge Denies Quixtar's Contempt Charges Against TEAM

Judge Felt TEAM Not Violating Court Terms

The legal battle continues on between one of the most popular multi-level marketing businesses and its former training consultants. This time the law was in favor of the trainers. Judge Sullivan of Kent County, Texas ruled on Tuesday that TEAM, the leadership training company who once worked for Quixtar, was not in contempt of a restraining order issued back in late August.

Quixtar felt that TEAM violated certain terms of that restraining order and filed a complaint on September 21. The accusation stated that TEAM is now a competing company which is in violation of the original contract that has been conducting movements in violation of the restraining order. They have since then sued 30 of the bloggers.

TEAM (which stands for Together Everyone Achieves More) is headed by Orrin Woodward and Chris Brady. Quixtar is a multi-level marketing company that provides products for independent business owners (IBOs) to sell. TEAM argued that they found some of Quixtar's business practices unethical and bordering against breaking the law and wanted their contract terminated. TEAM separated from Quixtar, a subsidiary of Alticor Inc., and sought to remove the "no compete" clause from their original contract. The "no compete" clause prevents TEAM from setting up their own distribution business; this is central to TEAM's demands, but Quixtar refused to let that part of the contract be voided. TEAM went on to file several restraining orders in courts across the country, including Texas.

Quixtar representatives also argued that TEAM held meetings specifically to recruit Quixtar employees away from them by encouraging a mass resignation. However, Judge Sullivan felt that TEAM did nothing wrong. "After giving much thought and consideration to the evidence presented by the parties the Court finds that there is no basis to sanction the named defendants or TEAM for violations of the August 28, 2007 preliminary injunction.", his statement read. The statement also noted that Woodward had taken extra measures to ensure the restraining order was issued by resigning from an authoritarian position with TEAM. "Woodward explained that his resignations were directly related to the Court order as he believed that plaintiff was 'after him' so he sought to back down from his role in TEAM to limit the chance that there could be a misconception by plaintiff regarding his activities."

Quixtar is a subsidiary of Alticor Corporate Enterprises. Alticor and its related businesses operate in more than 80 territories and countries worldwide.

    SO let me get this straight, your selling leadership books that help people within and FOR your own entity???? Get this, perpetual motion is impossible! Selling kits is like that chain mail that we get in the e-mails..... I hate MLM's!!

    Great report! The Character and Integrity of these leaders is unparrelled. They impress me more and more each day. Don't worry though, you wouldn't be giving any money to Orrin or Chris or even the TEAM. 100% of the all the profits of that book go to charity. (In June it was announced that Quixtar would be faded out and AMWAY would be the name again for Alticor's US based market)
