Back in August, the State Fire Marshal inspected the Meadow Lake Elementary and found that there were safety issues affecting handicapped people in wheelchairs. Unfortunately, a group called New Gateways leases 60 percent of the building to hold its meetings for developmentally disabled adults. They were facing eviction.

The group sued arguing that they were not given 30 days to fix the safety problems found by the State Fire Marshal. The group also challenged the marshal's finding that the group was not a school and therefore could not use the building, which is owned by Birmingham Public Schools.

Judge Phyliss C. McMillen found in favor of New Getaways and they will be allowed to stay in the building until their lease runs in March.
