Justice Department and California YMCA Reach Settlement in Autism Case
YMCA to Ensure that No Child is Discriminated Against
The complaint filed with the Justice Department some time ago alleged that the West End YMCA had wrongfully terminated a child from their after school program because the child had autism. The West End YMCA looked into the matter and will agree as part of this settlement agreement to implement policies and procedures to ensure that children with disabilities are given a full and equal opportunity to participate in any YMCA child care program.
The YMCA agreed to publish procedures in their organization's handbooks detailing the modifications that are being made to their approach in these types of situations. Additionally, YMCA will be trained on their obligations under the ADA and responsibilities in a child care environment. The West End YMCA also agreed to monetarily compensate the complainant in this case.
Assistant Attorney General for the Civil Rights Division, Wan J. Kim, stated, "Ensuring that children with disabilities, and their families, have equal access to reliable child care goes to the heart of the ADA's promises and protections. I commend the West End YMCA for working with us, and I hope that this agreement will be a model for other child care providers."
The American Disabilities Act, Title III, requires that child care providers do not discriminate on the basis of disability. Child care providers must also make reasonable assurances that individuals with disabilities are given the right to participate in and benefit from the services offered at the respective child care organization.
Autism affects approximately 1 in 150 people. It is a developmental disorder that can make communicating and interacting with others difficult. The Autism Society of America claims that 1.5 million Americans are affected by autism and that annual health care costs top $30 billion. The House recently passed a bill that provided significant increases in funding to autism related prevention, education, and treatment.
With the many children suffering from autism in the United States, it is important that individuals be aware of it and make certain that no child with autism is discriminated against. Autistic children can do many things very well. By quickly agreeing to favorable settlement terms for the complainant in this case, the West End YMCA has made a big step in reaching out to those suffering with autism.
