Landlord and Tenant Rights in the State of Mississippi

When deciding whether becoming a landlord or whether to rent a home in Mississippi is right for you, do your homework. Make sure you have a clear understanding of the laws Mississippi has in place for landlords and tenants. These laws are clear and precise and are written to protect all parties involved.

In Mississippi, when a tenant fails to pay their rent on time, a landlord must serve the tenant a three-day eviction notice. This must be done in writing and clearly state that the tenant has three days to pay rent due or the landlord will be forced to file an eviction notice with the local court system.

There are other reasons that a landlord may file an eviction notice with the courts. If a tenant damages property or in any way violates the lease agreement, a landlord must file a 30 day eviction notice. This gives the tenant a chance to either fix the property or find other living arrangements.

Mississippi gives tenants plenty of time to pay any past due rent during the eviction process. A landlord may not evict a tenant by force; eviction must be done through the court system. If a tenant pays his/her rent during the eviction process, the courts will allow the tenant to remain living in the property. Mississippi laws require the landlord to accept payment and landlords may not find new renters unless the court orders an eviction.

In most cases, the entire eviction process can take up to five weeks. This may end up being a little longer in some cases and a little less in others depending on the actual circumstances. Mississippi provides rights to both landlords and tenants that are fair and give both parties involved equal opportunities to resolve disputes fairly.

Landlords may not physically remove a renter from any rental property in Mississippi. Any evictions must be court approved and decisions of the court must be followed.
