Lemkau Sacrificed Baby Wyatt to Psycho Dad; Protest March Says 'Lemkau Must Go!'

After Murder, Citizens Say, 'We Demand Justice for Baby Wyatt!'

Rik Merchant
Feb. 27, 2020; Calif.; A march on Lemkau in protest of the murder of Baby Wyatt will happen on Monday March 8 beginning at 7:45am at 14455 Civic Drive, Courthouse Victorville, in San Bernardino County. Lemkau Must Go! is the recurring mantra of a community heartbroken and devastated over the preventable murder of Katie Tagle's nine-month-old-son Wyatt Garcia.

Not only has Superior Court Judge Robert Lemkau not stepped down after his callous role in the murder of Baby Wyatt but he has outraged the desert community of San Bernadino County by audaciously running for re-election. He seems either indifferent or oblivious to their pain over the January 31 death.

Just ten days before the tragedy, Katie Tagle was powerless to convince Judge Robert Lemkau to make a temporary restraining order against Baby Wyatt's father, Stephen Garcia, permanent. Lemkau's denial gave Garcia unsupervised visitation rights. Now, the desert citizens of San Bernardino County are empowering a protest against the 'judge of poor decisions'- and a 'poor judge of character'.

Judge Lemkau not only refused to listen to Tagle's statements and refused to review her evidence that psycho-dad Garcia- who committed suicide right after shooting Baby Wyatt- had threatened several times to kill their baby, but Lemkau called Tagle a liar in almost every other sentence he uttered during the hearing with Garcia present. The court transcript illustrates these facts clearly. Tagle's ex and the father of her son Dakota, Richard Tagle, told the Hi-Desert Star, "The judge had not read the exhibits... He started out by saying, 'one of you is lying. I think it's you,' and pointed to Katie."

Having no qualms in judging without hearing and pronouncing without fair deliberation, Judge Lemkau blindly and deafly ordered full custody. "I'm going to keep the full custody orders in full force and effect," said Lemkau. His decree became a death sentence for Baby Wyatt.

Election Day is on June 8, 2010. Young Deputy District Attorney James Hosking will run against the incumbent Judge Lemkau. But the contentious Lemkau may not be in office. San Bernardino citizens may unseat him before June 8 rolls around.

Judge Lemkau was removed from the Criminal Court for his poor decisions. He was placed in the Family Court. Now there's nowhere for him to go but out of office.

Update 2/27pm. San Bernardino County is the largest U.S. county and has a population of roughly 2,000,000. Baby Wyatt as a Yucca Valley resident belonged to the desert community. Yet, the desert community strongly hopes the 'other side of the mountain' will join the protest march on March 8- just three months before Election Day- against Judge Lemkau, whose court decisions affect all of San Bernardino County.

Baby Wyatt was murdered by his father, a PiƱon Hills man, in Twin Peaks after a chase along icy mountainous roads, first by Hesperia Sheriff Deputies and then by Twin Peaks Sheriff Deputies.

We wonder why are courts are corrupt and are children are placed with child molesters and murderers. While sheriff Rod Hoops was believed to have disposed of and covered up that Sergeant Randy Beavers was involved with under aged children and child porn. How many of these types of crimes exist within the S.B. county sheriffs dept? This type of thing is happening in our communities often but they are too often swept under the rig by our corrupt elected officials.

this judge recently awarded custody to my husband's 7 year old daughter's grandparents after his ex wife passed away in may. there has never been any proof of unfit parenting ((he's a great dad)). judge lemkau didnt even allow my husband to speak on his behalf. i hope he goes down in flames!!! poor baby wyatt, to think this could have been avoided if he had just taken a moment to do his job correctly! we would have our daughter, and she would have her son.

It is ironically tragic that a MORMON JUDGE SENTENCED A 9 MONTH OLD INFANT TO DEATH without so much as a fair hearing on the facts, when a TYPICAL CONVICTED MURDERER will cost the judicial system over $5 million dollars and an average of 14 YEARS to finally EXECUTE.
What did Judge Lemkau have on his calendar that day that was more important than protecting the life of an innocent child?
Perhaps Judge Lemkau was tired, distracted, overworked, maybe even underpaid (making only $300K+ per year), maybe he was "having a bad day", maybe he "could not foresee" the consequences of his hasty and ill-considered opinion, PERHAPS HE DID NOT EVEN READ THE PLEADINGS, but whatever excuse he now provides, the fact remains JUDGE LEMKAU SENTENCED AN INNOCENT, 9 MONTH OLD CHILD TO DEATH!
THOSE WHO OPPOSE CAPITAL PUNISHMENT DO SO ON THE BASIS THAT EVEN ONE MISTAKE WILL SENTENCE AN INNOCENT MAN TO THE GALLOWS - - THAT IS EXACTLY WHAT JUDGE LEMKAU DID IN THIS CASE.
    THERE IS NO "SECOND CHANCE"

The desert community is going insane over the death of Baby Wyatt and Lemkau's decision. We just hope it stays in the news until the election in June/ I hope population on the other side of the mountain pick up on this tragedy and will kick Lemkau off the bench. We don't need anymore citizens accused of lying when they have proof of threats. I wouldn't want Lemkau to be a dog-catcher!

This case is sad beyond words.
