E-Trade is being sued $100 Million dollars over one of its super bowl commercials. In E-Trade's memorable super bowl commercials, they are most remembered for the "talking babies." In the most recent super bowl, one of the commercial's featured the so called "milk-a-holic" baby named Lindsay. The super bowl ad can be seem here.

The 23 year old actress, Lindsay Lohan feels that the E-Trade "milk-a-holic" ad is modeled after her. Lindsay Lohan's lawyer, Stephanie Ovdia, says that Lohan is owed $50 million in exemplary damages, plus another $50 million in compensatory damages. Lindsay Lohan also want to have the ad removed off the air and to receive every copy of the commercial. They claim that E-Trade has violated Lohan's rights under New York state civil-rights law and used her "name and characterization" in business without paying her or getting her approval. They assert that this add has been since by millions of people who watched the Super Bowl and has given E-Trade huge profits.

Stephanie Ovadia told the New York Post. "They used the name Lindsay. They're using her name as a parody of her life. Why didn't they use the name Susan? This is a subliminal message. Everybody's talking about it and saying it's Lindsay Lohan." Ovadia stated that many celebrities are known by one name only, such as Oprah, Madonna or Cher."

Grey Group, the company who produced the "milk-a-holic" commercial for E-trade, said that they "just used a popular baby name that happened to be the name of someone on the account team."

E-Trade hasn't given an official statement on the situation.
