Mike Sorrentino from MTV's Jersey Shore Can't Trademark "The Situation"

Mike Sorrentino is known to millions not by his name but by his nickname: The Situation.

Mike "The Situation" Sorrentino is one the stars of Jersey Shore, the hit reality show on MTV, and will appear on the upcoming season of Dancing with the Stars. He is known well by his love for calling himself and his abs "the situation." Mike has a following of women who love his abs and men who find him a role model. Many just find him amusing because of his routine references to his abs and himself as "The Situation." Whether people love him or hate him pretty much everyone knows who he is - The Situation from Jersey Shore.

However, a new situation leaves Mike unable to profit from the name. On one episode in the first season of Jersey Shore Mike says he needs to trademark the name and even filed an application with the US Patent and Trademark Office earlier this year to trademark "The Situation." He planned to use the trademark for a clothing line. Unfortunately for him the application was denied because the trademark already is trademarked.

Julio Aref has the trademark for his chain of four clothing and shoe stores in Memphis called "Situation."

Would Aref be willing to consider selling the trademark to the Jersey Shore reality star? Of course. As he says, "I'll talk to anybody. I'm a business man."

Sorrentino's legal team tried to argue the difference between "Situation" and "The Situation" referring to him, but they were unsuccessful. It looks like Mike will have to come up with another name for his clothing line with partner Dilligaf by Bohica Bill.

    hey paisan,make as much money as possible! rumor has it, you have your own brand of vodka coming out also? as far as purchasing the rights for the nickname, see what your legal team can come up with, I see some wiggle room.
