Miley Cyrus Has Wardrobe Malfunction During Video Shoot

It is being reported all over the internet that Miley Cyrus had a wardrobe malfunction, a nip slip, if you will, at a video shoot in Santa Clarita, California. There are promises of nude pics, naked pictures, nude photos, video, and images everywhere you click. And, of course, there is the usual saucy or inelegant statement, the witty innuendo about her age and her 20-year-old boyfriend, the comment about her waywardness or her lack of good parenting, and the now all-too-common comparison with Britney Spears. Yes, Miley Cyrus' wardrobe malfunction has become not only a hot search topic but an open forum on the dos and don'ts of parenting and the voyeuristic nature of society in general.

As Britney Spears might observe, it has become a circus.

The Post Chronicle and hundreds of other web sites are reporting the Miley Cyrus wardrobe malfunction as if it were a Janet Jackson Super Bowl repeat. The agency covering the video shoot stated, "Miley's dress was so low-cut breast popped out in front of about 15 crew members." Apparently, Cyrus was shooting a scene riding a horse in a very tight dress and...

There are some that are purporting to actually show the "Hannah Montana" star's little slip.

But therein lies the problem with showing wardrobe malfunctions, especially of certain individuals. Normally, all things considered, a Miley Cyrus wardrobe malfunction would simply be the latest click-fad on the internet, everybody trying to get a glimpse of the naked body part in question. Normally. But in this instance, the purveyors of Miley Cyrus' naked breast, regardless of whoever they might be, and the audiences of Miley Cyrus' naked breast, regardless of whoever they might be, are engaging in the dissemination of child pornography.

That is correct. Child pornography. Miley Cyrus is just 16 years old.

Just short of two weeks ago, charges were filed against six Pennsylvania high school students for manufacturing, disseminating, and accessing child pornography because the underage girls took naked pictures of themselves and sent those same nude photos to their underage boyfriends. It is a common practice called "sexting."

Miley Cyrus is not of the age of majority, nor is a wardrobe malfunction considered a "work of art," which is one of the few exceptions to the child pornography rule, and one of rare exception at that (such as the album covers of Blind Faith and Scorpions' "Virgin Killers"). The unintentional naked moment captured in a photo does not constitute art, even if the wardrobe malfunction occurred while making the video.

The naked image is one that constitutes child pornography. Unlike the risque photos taken for the Vanity Fair photo spread last year that resulted in such controversy and an apology from Miley Cyrus, this is not "nearly" or "almost" pornographic. It is child pornography.

Forget that Miley Cyrus as "Hannah Montana" on the Disney networks is a teen icon. Forget that Miley Cyrus / Hannah Montana is adored by millions of youngsters, child, tweens, and young adults. Forget that she has produced some rather racy and risque material herself. She is still an under-age teenager.

Although the public and her adoring fans have been close (the shower scenes and racy photos of a Miley Cyrus partially naked on MySpace), they have never been to this point.

Allowing websites to post and pander to voyeurs is one thing. Allowing those same websites to post and disseminate the image of an underage celebrity is another. It is illegal.

Hopefully, before this little episode gets too far along, authorities will look into the matter and either shut down the sites involved or at least order that the images be removed from the websites - with concomitant arrests and heavy fines. Arresting teenagers who more than likely knew what they were doing was illegal is not the same as purposely exploiting Miley Cyrus' naked breast to gain traffic to a website. However, it is covered by the same federal laws.
