Miss California Carrie Prejean Topless; Semi - Naked Pictures Could Cost Her the Crown

Miss California Carrie Prejean (until further notice) just can't seem to stay out of the news. Now, because of a couple of semi - naked pictures taken a few years ago, she might be losing her title. It seems that Carrie Prejean posed topless for some photos in some skimpy underwear and it just might be a breach of contract with the Miss California USA organization.

Ever since Miss California experienced some sort of aneurysm or something at the Miss USA Pageant and lost (due to the sudden onset of incoherency), she has been the center of controversy generated by others as well as herself. She went on a talk-show tour, promoting her pro-family, anti-same-sex marriage ideology. Conservative organizations and pundits embraced her. Gay activists and pro-same-sex marriage organizations openly ridiculed and publicly excoriated her. Miss California USA wanted Carrie Prejean to be quiet and sit down and talk with a her opponents. Instead, Prejean kept making statements, including a appearing in a video for the National Organization for Marriage. It also became public knowledge that Miss California USA had paid for Carrie Prejean to have breast implants. And, finally, topless pictures surface which not only might see her stripped of her Miss California crown but also has caused many who were championing her to question her veracity and her convictions.

But what exactly did Miss California Carrie Prejean do wrong?

Nothing -- or so it might seem. She made a mistake in her answer about existing law in the United States regarding the choice of same-sex marriage, which made her answer sound ignorant, uninformed. Otherwise, she was simply stating her opinion. Like it or not, she's still entitled to it. Uninformed, it was was still hers to have and to state.

So Carrie Prejean is pro-heterosexual marriage and anti-same-sex marriage, and... And what? Millions of others are as well. Although that opinion may irritate some, it is still only an opinion. It does not mean that she should be stripped of her crown.

Nor do the topless pictures that have surfaced of her... Unless...

According to Access Hollywood, the contract that Carrie Prejean signed with the Miss California USA organization states that she never posed for naked or partially nude pictures of herself. The Miss California USA contract reads in part that she agreed that she had never appeared in public or permitted herself "to be photographed in a state of partial or total nudity or in a lewd, compromising or sexually suggestive manner [which] constitutes a violation of this provision (this includes photographs of images that may appear on any Web site, such as MySpace of Facebook)."

TheDirty.com was the first to obtain and post a younger looking Carrie Prejean turned away from the camera, arms crossed over her breasts, obviously topless, wearing nothing but a pair of pink panties. They have posted two photos thus far, one after Carrie Prejean assured TMZ in an e-mail that the first semi - naked picture of her was the only one of her. Oddly enough, for there to be only one, the website promises more to come.

But Prejean defends these topless pictures as simple model shots and nothing more. It is being argued that she really isn't naked in them and that she is baring nothing to world in the pictures. In all fairness to Miss California, there is barely a small portion of breast showing, far less than was exposed in her white bikini at the Miss USA Pageant.

However, there is the question of the topless pictures fitting the description of "lewd."

On the one hand, a younger Carrie Prejean looking over her shoulders at the camera holder, wearing nothing by a smile a thin pair of pink panties might be considered provocative and lewd. On the other, it could be considered playfully modest. Or one could take it at face value, being that of a young model practice-posing for an ad that sells underwear (which it was not. Prejean said it was a private picture never meant to be disseminated).

Carrie Prejean maintains that the topless pictures are meaningless. She maintains that she is a Christian and stands behind her stances on family values and marriage.

Some are saying that Carrie Prejean is a hypocrite and the semi - naked pictures prove it. Some say that her pro-family values stance is a sham and a way to garner publicity. Carrie Prejean says that the anti-same-sex marriage, attempting to "save" the institution of marriage as that between a male and female, position is something that is near to her heart.

But if Miss California USA is looking to strip Carrie Prejean of her title as Miss California, one would think they would have something stronger than a picture or two of the naked back of Miss California. It seems that the Miss USA organization, along with the Miss California USA group, have become quite embarrassed by Prejean's anti-same-sex marriage campaign and are looking for a way to strip her of her title. But one would hope that Miss California USA would have the good grace to not do so on such flimsy evidence.

Because, like her or not, agree with her or not, the current topless picture scandal does not seem to merit Carrie Prejean losing her crown. But, in the end, that decision rests with those closer to the pageant organization, and they have made it clear that they oppose Carrie Prejean's using her title to promote her sociopolitical agenda.

Because ultimately Prejean's semi - naked pictures aren't the issue but a means to an end -- the end of Carrie Prejean as Miss California USA. And it all began with an honest stance and a poor choice of words...
