Nebraska Signs Pain-Capable Unborn Child Protection Act into Law

Nebraska Governor Dave Heinemen signed the "Pain-Capable Unborn Child Protection Act" into law protecting unborn babies more than 20 weeks along in gestation on April 13. The significance of LB 1103, which passed Nebraska's legislature on a vote of 44-5, is immense.

"People who know nothing about abortion get it. You don't need coursework in fetal anatomy to know that babies this mature will suffer excruciating pain as they are being torn apart," said Mary Spaulding Balch, National Right to Life's State Legislative Director. In Nebraska, such late term abortions are now an "intentional or a reckless violation of the Pain-Capable Unborn Child Protection Act" and the abortionist can be sued for damages.

With unintended tragic irony, pro-abortion Nancy Northrup, President of the Center for Reproductive Rights commented that LB 1103 is "like taking a huge hacksaw to (abortion) rights." No, these late-term abortions are not performed with hacksaws, but the unborn babies do have their skulls crushed and brains removed by suction during partial birth abortion. This is a procedure any living being would resist. Even diehard pro-abortionists must admit that a beating heart and moving arms, legs, fingers and toes, plus increased stress hormones, constitute a living being trying to dodge an instrument of death who is not "just a conglomeration of cells." If this agonizing death were inflicted on the unborn of any other mammal it would be considered abhorrent. And now, in Nebraska the silent screams of unborn children are finally being heard.

When Roe v. Wade passed in 1973, we did not have in-utero surgery and 4-D ultrasound. We did not have technological advances in fetal care that move the point of viability to 22 to 24 weeks, and we could not prove that the unborn child feels pain at 20 weeks gestation if not before. (Nerve fibers designed to sense pain are present in a fetus's skin seven or eight weeks after conception, said Dr. Terence Zach, chairman of pediatrics at the Creighton University School of Medicine.)

According to an AP report, the Nebraska bill, which was introduced by Speaker of the Legislature Mike Flood, bases its assertion that fetuses feel pain on the testimony of doctors, some of it given during a 2005 Congressional hearing on the subject. It contends there is substantial evidence that "by 20 weeks, fetuses seek to evade stimuli in a way that indicates they are experiencing pain." So we have known this since at least 2005.

So far, Oklahoma, Arkansas, Utah, Georgia, Louisiana and Minnesota are the only six states in the US where doctors are required to tell mothers their pre-born babies feel pain. Some add the requirement that the mother be given the choice to have the unborn child anesthetized during its death. After all, even "animals in slaughterhouses are protected from excessive pain," Flood remarked. A pre-born human child is at least as important as a dying cow and "deserves that level of sensitivity." (As quoted by Omaha.com.)

Even in Nebraska they intend to allow exceptions for "the health of the mother." But late term abortion is not healthy for the mother. Not physically, spiritually or psychologically. Hormonal and physical changes in the mother during pregnancy are aborted along with the baby. There is a link between breast cancer and mothers who have abortions, and abortion providers have been successfully sued for not informing patients of that link.

Anyone who thinks that it's mentally healthier for a mother to abort her moving, kicking baby in-utero than to allow it to live has never been pregnant. Most importantly, the bible maintains that we are made in the image of God, and that He knew us before we were ever in our mothers' wombs. From the Creator's perspective, abortion is just another way to murder a child of God.

Will other states follow Nebraska's example? "Kansas lawmakers recently approved a bill that would require doctors to list an exact medical diagnosis justifying a late-term abortion. It adjusts the definition of viability to a "reasonable probability" a fetus would survive outside the womb with life-sustaining measures such as an incubator, among other changes." This bill will severely hamper the late-term abortion business of LeRoy Carhart, who specials in abortions past 20 weeks, and could force him to relocate his late-term abortion business to another state, or close it altogether. The Alan Gutmacher Institute claims that there have been more than 50 million abortions in the U.S. since Roe V. Wade in 1973.

Note to my pro-choice friends: You are the people who do not want to interfere in anyone else's life choices, or judge anyone, or intentionally inflict discomfort on anyone. It may even be one of your life goals to do anything within your power to alleviate cruelty, poverty, hunger, pain and lack of opportunity. You now know that unborn babies after 20 weeks gestation feel pain during death. You may be pro-choice, but you are not pro-torture.
