After refusing to take a breathalyzer test, McCray, was charged with speeding, driving while intoxicated, driving without a vehicle registration and careless operation of a motor vehicle.
McCray was booked into the Orleans Parish Jail and released around 7 am Tuesday morning on his own recognizance. He did not resist arrest.
Under Louisiana state law, anyone refusing to take a breathalyzer testthat is suspected of driving under the influence will lose their drivers license for a period of one year automatically.
McCray, 28, took over the starter position of defensive end for the Saints after Charles Grant was injured in 2008. He had a good season with the Saints in 2008 with 6 sacks and 37 tackles.
McCray has played as backup this year and has played in all 15 games with 1.5 sacks and 10 tackles to his credit. McCray is signed with a 5 year contract with the Saints.
The Saints are 13-2 for the season and have clinched the NFC title, earning a first round bye in the play-offs and home field advantage.
The Saints camp didn't have a whole lot to say about the situation other than they were aware of the arrest.

It's just amazing how everyone leaving comments knows what happened. Let's just consider innocent until proven and how would you feel if you got pulled over, had no alcohol on your breath, and the trooper wants to puff out his chest to show he has a badge. Just like athletes, 99% of police are good, honest people, but there are asses out there that make others in the proffesion look bad. And before all the ignorant comment come, I am an officer. Remember-innocent until proven guilty. P.S. to Jane Vee, what is sad is our children have role models (you) that condemn without the facts. If he is guilty, prosecute him, if not? Oh yeah, already convicted in public. what a shame.

Many of these sportstars think they are above the law. Not being good role models for their hard working and often lowly paid fans.
There should be no driving after drinking.
