Nuisance Neighbors - What to Do About Them

With the increase of the population comes the problem of housing and neighbors who wish to impose their own way of life upon everyone else. In England, there is a law written known as Law of Nuisance focused on property disputes among neighbors in court. Meaning, the plaintiff complainer states that the behavior of the defendant culprit is intolerable, and must stop immediately.

The dispute must be defined in either a public or private problem experienced by the neighbors. It is even worse when there is an angry dog tied up to close to your property, so you feel afraid to pass by it.

Another form of dispute is a public one that affects everyone on the street such as noise from a barking dog all hours of the day, drivers blasting music from cars, a horde of people up at all hours of the night drinking and cursing loudly. The public nuisance could be a medicine factory that emits fowl odors, business with too much traffic, or a light that shines directly into peoples windows to make viewing difficult. In order to make a full complaint, and ask for legal relief it must be a constant reiteration of the same routines. In addition, the neighbor will have to change behavior by limiting the usual routine or the courts will place an full prohibition on the behavior of the nuisance neighbors. The courts decision is based on different factors regarding the area zoning and restrictions of the areas in order to determine what is legal.

For instance, business and housing located in the same area is zoned for both to exist together. Therefore, it would be incorrect to label it as a quiet residential street when it is more than that. Nevertheless, businesses should co-exist with the home owners in mind in terms of hours of operation. People who work each day needs their rest without the interruption of all night businesses.

On the other hand, a quiet residential street that is not zoned for any particular noise or bad behavior is grounds for legal action. Perhaps, getting a neighborhood watch community in your neighborhood with the assistance of the police deputy can help get those neighbors out. Sometimes it isn't good to confront them to their face when they seem like they are dangerously streetwise, but to seek outside help. Nuisance neighbors will sometimes retaliate by slicing tires, leaving dog droppings, trying to set cars afire, taking off the sewer cap of each neighbor, or driving by with a weapon.
