Sex Offender Caught and Sentenced

Davie Joe Backus, 41, Ponca City, Oklahoma, has been captured and sentenced in Kay County District Court on a felony charge of failure to register as a sex offender.

Backus pleaded guilty to the charge on Dec. 18, 2008.

He was convicted of the crimes of first degree rape on Aug. 13, 1995, in Osage County, Oklahoma, and of rape by instrumentation in Kay County, Oklahoma on Dec. 30, 1995.

He was sentenced to one year in the county jail and ordered to register as a sex offender on that charge.

Backus was then convicted of failure to register as a sex offender in July of 2005.

He was sentenced to five years in the Oklahoma Department of Corrections. After serving three months in the county jail, the balance was suspended.

In November of 2007 he was again charged with a felony count of failure to register as a sex offender.

He pleaded guilty and was sentenced to four months in the county jail.

On Oct. 22, 2008, Backus was arrested at a travel trailer parked behind a residence in the 1300 block of South Twelfth Street and charged with failure to register as a sex offender.

He was set for sentencing on May 21 when he failed to appear.

Bond was endorsed in the amount of $10,000.

He was taken back into custody in July and sentenced on Sept. 17 to three years in the Oklahoma Department of Corrections.

After serving one year in the Kay County jail the remaining balance is suspended
