To start with let us figure out the scope of a prenuptial agreement and later we will discuss its practical advantages. Because a prenup is a legal contract, it can be defended in the court and is supported by the law of the land. The scope of such an agreement is wide and its definition depends on the involved parties. However, mostly it has clear-cut laid down terms and conditions to be followed in case of a division of property, break up of marriage, alimony after divorce etc.
After reading the above paragraph, you might be thinking that a prenuptial agreement sounds quite negative when the couple is planning to take vows to lead their entire life together with love and supporting each other. However, it is a desirable perquisite for a happy marriage. Having prenuptial agreement is definitely a recent phenomenon, which is gaining popularity with each passing day. It is true that romantic couple cannot even think of a possible situation in which they would separate from each other and fight over issues like money. However, you need to think of prenuptial agreement in positive terms. It is an agreement, which will lay down solid foundation for your marriage. Having such an agreement means that both the individuals will be equally responsible for their marriage and they cannot take advantage of one another in any eventuality.
A prenup has many practical advantages, which become obvious in time in case there is any problem in marriage. Because premarital agreement tells clearly how the couple will utilize their assets acquired during marriage or after it, there are very few chances of ugly break up. One of the cases in which a prenup can help is that you can save yourself from paying your partner's debts. Child support and custody issues can also be resolved based on the terms and conditions outlined in a prenup agreement. Alimony and monthly maintenance for the child can also be settled easily later. Even though it may not settle all issues and court of law will decide all the issues, which are not defined in the prenuptial agreement; a prenup is a good way to minimize such confrontations later. It will provide a sense of security to the couple too.
Do not think that a prenup is meant for rich and famous people only. A prenuptial agreement is for you and me and for everyone who is going to get married soon. It is important to discuss this matter with your partner before marriage with all openness and empathy. The parties should not force premarital agreement upon each other, but should amicably define all the clauses and content of the agreement. Both the individuals can choose their own lawyers or agree upon one lawyer. Before you sign on the premarital agreement, know what you are agreeing upon and let the other partner also know all the details. More the transparency between the partners, stronger will be the foundation of the marriage.
